What the inspector wrote

(CONTINUED FROM LIC 9099) Four (4) of five (5) children interviewed confirmed LIC uses corporal punishment against children in care. One (1) of four (4) children reported they have observed LIC smack a child in care. Two (2) of four (4) children reported they have observed LIC slap a child in care. Two (2) of four (4) children reported they have observed LIC spank a child in care, and one (1) of four (4) children reported they have observed LIC hit a child in care. Additionally, four (4) of five (5) children interviewed confirmed LIC uses isolation in time out as a form of punishment against children in care. During an interview with LIC, LIC reported to LPAs that she utilized time out to keep Child #1(C1), Child #2(C2), and Child #3(C3) separate "the whole time" for discipline. Regarding the allegation "Licensee did not provide day care child with privacy while using the restroom", it was alleged that LIC forced her way through the closed restroom door while C1 was using the restroom. Three (3) of five (5) children interviewed confirmed they observed the incident occur when LIC forced her way into the restroom while C1 was using it even though C1 was asking for privacy. One (1) of five (5) children reported they had experienced LIC banging on the restroom door while using the restroom, while another child interviewed reported they had experienced banging on the door while using the restroom but was unable to tell who was doing it. Based on LPA’s observations and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, are being cited on the attached LIC 9099-D. An exit interview was conducted with LIC and a copy of this report and LIC 811- Confidential Names list and a Notice of Site Visit were provided. Appeal Rights were also discussed with LIC and provided as well. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility for the next 12 months. Licensee will provide LPA with a copy of each parent/guardian's signed Acknowledgement of Receipt of Licensing Report form. The original signed copy must remain in each child's file. The Notice of Site Visit and Type A Deficiencies from today’s visit must be posted for 30 days. Failure to keep these posted for the entire 30 days will result in an immediate $100 civil penalty for each. (CONTINUED FROM LIC 9099-A) exchanges pertaining to the family child care home after possibly observing C1 recording. Two (2) of five (5) children interviewed confirmed they had observed LIC take C1's cell phone and view items contained in the cell phone and although they could not confirm what LIC did while in possession of the cell phone, certain items were no longer contained in the phone following LIC's handling of the cell phone. During interview with LIC, stated C1 had tried to scare her by telling her they had recorded things while at the day care. LIC also reported she had informed C1's parent that doing so was not legal. LIC denied ever looking at what C1 was doing on their cell phone or ever looking at what was contained in the cell phone. Although the allegations may have happened or are valid, there is no preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated. An exit interview was conducted and a copy of this report was provided along with LIC 811- Confidential Names list. *No citations were issued; therefore Appeal Rights were not provided.

LIC did not ensure personal rights were maintained for children in care. Based on observations and interviews, 5 of 5 children confirmed LIC spoke inappropriately to children in care. This poses an potential health, safety, and personal rights risk to children in care.

    (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not be limited to: Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children.
