also revealed that they did not believe the incident happened since C1 was only at the facility for a week and would only stay at the daycare for approximately 15 minutes before being picked up. A separate investigation was also conducted by Hemet Police Department, and the case was closed due to insufficient evidence. Regarding the allegation that the Licensee left day care children unattended, it was alleged that the Licensees would leave the children under the care of their older sons. Confidential interviews conducted revealed that the Licensees would leave the children under the care of spouse, who is the Co-Licensee, and their older children if needed to run errands or step away from the facility. According to interviews conducted with staff and children, LPA also confirmed that the daycare would always ensure that an adult staff was always in the daycare and would never leave the children alone in the care of a minor. Regarding the allegation that the Licensee allowed unqualified individuals to provide care and supervision, LPA Hamilton conducted a review of Staff records and verified that all adults associated and working at the daycare were qualified, per Title 22. Pertinent interviews with staff, children, and residents of the home were also conducted, and LPA confirmed that the individuals providing care and supervision were all adults and had the required training and clearance. Regarding the allegation that there is an adult that poses a risk to the daycare children in care, LPA Hamilton reviewed the staff files and verified that all adults providing care and supervision and residents living in the home had a fingerprint clearance. LPA also reviewed the files to ensure staff were qualified to provide care and supervision and noted that the documentation on file was current. In addition, the daycare was recently being investigated due to a complaint that alleged that an adult had sexually assaulted a child while in care; however, that allegation was found to be unsubstantiated by Community Care Licensing Investigations Bureau and the Hemet Police Department due to insufficient evidence and determined the adult was not a risk. Based on the information gathered, LPA could not corroborate allegation that an adult poses a risk to the children in care, therefore, the allegation is UNSUBSTANTIATED Based on confidential interviews and records review, the allegations daycare child was sexually abused while in care, licensee left daycare children unattended and licensee allowed unqualified individuals to provide care and supervision, may have occurred, however are not supported or proven by evidence. Therefore, the allegations are unsubstantiated. An exit interview was conducted, a copy of this report, Appeal Rights, and Notice of Site Visit was provided to Licensees Melissa Torres and Alexander Torres. The licensees were reminded that the Notice of Site visit must remain posted for 30 consecutive days and violation of this regulation may result in civil penalties.
