What the inspector wrote

The preponderance of evidence has been met and the above allegation is SUBSTANTIATED. SEE LIC 9099D FOR DEFICIENCY CITED. A copy of this report will be emailed to Ms. Barrera on 02/11/21. A return email acknowledging the receipt of this report will be used in lieu of a signature due to the COVID-19 pandemic. Due to the COVID-19 State of Emergency, this report was completed via Tele-Inspections Report Delivery Instructions. Appeal Rights discussed and will be provided along with a copy of this report via email to Ms. Barrera on this date. A copy of this report must be available, upon request for three years.

    PERSONAL RIGHTS

    Personal Rights - Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (4) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature. This requirement was not met as evidenced by a child who was “smacked” on the hand for an unknown reason by the Licensee that made the child feel sad and cry.
