What the inspector wrote

Confidential records received, disclosed that the facility is not over capacity at any one time. It was alleged that the front yard of the FCC has a play area facing the main street, that is secured with a rotten fence, and that there are dry weeds, bushes covering the windows and blocking an entrance/exit. LPAs observations on 10/05/23 revealed there were some weeds, and the fencing needs repairing, however it is not held together by chairs, no evidence of dry weeds or bushes blocking an entrance/exit at time of inspection. A deficiency was given during annual compliance inspection and immediately cleared. Nine Confidential interviews denied the FCC being in disrepair, and noticed the house is always clean, and love that the FCC decorates for the holidays. It was reported the FCC has adult visitors during the day care hours, and when the family leaves on vacation or for events, different friends come over to watch the children. Interview with S1 denied allegation that she leaves the children with anyone other than herself or her husband, and if they do it is with someone cleared to be in the FCC. Nine confidential interviews denied that the children are left with anyone other than the licensee and her spouse, stating they feel very happy with the care the FCC provides for the children. Confidential interviews disclosed that one child was injured while in care on at least two occasions, and the home is a little dark at times. It was reported that S1 and S2 openly share how they take turns getting intoxicated while they are caring for their children. It was also reported that there was a parent openly yelling at the licensee because she caught S1 drinking wine in their garage’s full bar. LPAs observations revealed the full bar, is locked behind two different types of locks to prevent access to children in care. Confidential interview disclosed that the neighbors across the street, made a complaint that A8 and S1, would fight outside, yelling at each other, but admitted that they both talk loudly when joking with one another, but never argued. It was reported that the erotic behavior of S1 was concerning for someone that watches children in a day care. Eight confidential interviews denied having concerns about S1, S2 being under the influence of alcohol or any other substance, stating they have never seen the garage door open at any time. Confidential interview disclosed that at least on one occasion the outside garage door was open upon pick up of their child and it looked like S2 was working on the yard, no children were in the garage or near the entry. Based on interviews and record review the allegations that the facility is over capacity, the facility is in disrepair, the facility does not provide a safe environment for day care children, the licensee is under the influence while providing care and supervision to day care children, may have occurred, however are not supported or proven by evidence. Therefore, the allegation is unsubstantiated at this time. An exit interview was conducted and a copy of this report and appeal rights were discussed and provided to Licensee Brett Berroteran. A notice of site visit was also provided, and licensee was reminded the notice must remain posted for 30 days.
