Based on observation and interview, the licensee did not comply with the section cited above. In touring the facility, LPA observed a kiddie pool on the playground with standing water. LPA was informed that the pool was used the previous day and the water had been standing since then. This poses an immediate health, safety or personal rights risk to persons in care. A civil penalty of $500.00 was also issued with this citation.

Based on record review, the licensee did not comply with the section cited above. In reviewing children files, Child #7, was missing an Acknowledgement of Receipt of Licensing Reports (LIC9224) for a Type A citation that was issued on 7/23/2024. This poses/posed a potential health, safety or personal rights risk to persons in care.

Criminal Record Clearance Requirements - Initial Clearance

Based on observation and record review, the licensee did not comply with the section cited above. Staff #1 was observed proving care and supervision however, the staff did not have a criminal record clearance in order to be employed at the facility. This poses an immediate health, safety or personal rights risk to persons in care.

Based on record review, the licensee did not comply with the section cited above. Staff #1, #3 & #4, did not have proof of completing the required training on file. This poses/posed a potential health, safety or personal rights risk to persons in care.

BUILDINGS AND GROUNDS

(a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.This requirement was not met as evidenced by: On 05/13/22 and 08/04/22, LPAs observed four classroom windows to be cracked and/or shattered. One window is shattered with exposed sharp glass protruding outward. This poses an immediate Health and Safety risk to children in care.

TEACHER QUALIFICATIONS AND DUTIES

Teacher Qualifications and Duties:(c) To be a fully qualified teacher, a teacher shall have one of the following:(1) Twelve post-secondary semester or equivalent quarter units in early childhood education or child development completed,...This requirement is not met as evidenced by: On 08/04/2022 a file review was conducted for S1 and it was observed learned that there was a staff member working as a lead teacher from August 2021 to present without 12 Early Childhood Education units (ECE), the staff only had proof of 9 ECE units in their file.

(go) Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children.This requirement was not met as evidenced by: On 05/13/22 and 08/04/22, LPAs observed a bucket of water half filled mixed with a cleaning agent accessible to children in the children's restroom and in the children's outside play area, mops were accessible to children. Also multiple brooms and dustpans were accessible in the corner of one bathroom and classroom. This poses an immediate risk to children in care.
