What the inspector wrote

On August 9, 2022 at 12:02 pm, Licensing Program Manager Stephanie Hudak and Licensing Program Analyst (LPA) Lorena Valenzuela arrived at the facility to conduct an annual inspection as part of a compliance review. LPM and LPA were greeted and granted access to the facility by licensee, Denia Diaz. LPM and LPA toured the facility, inside and out, records were reviewed, and the following was observed and/or discussed: \302\267 Normal days and hours of operation are: Monday through Friday, 7:30 AM to 5:30 PM \302\267 OFF-LIMIT AREAS INCLUDE: garage, bedrooms and laundry room \302\267 The facility was not operating within the licensed capacity and appropriate ratios. During time of inspection there were eight day care children in addition to two of the licensee's own children under the age of 10. \302\267 Appropriate supervision provided during this inspection \302\267 A working telephone is present and the current number is on file \302\267 One of two smoke detectors was not operational due to lacking batteries and carbon monoxide detector present but was not installed, and per licensee needs batteries. There was a fire extinguisher observed \302\267 The facility does not have a Fireplace \302\267 All hazardous items are not stored inaccessible to children. LPA observed cleaning chemicals in the bathroom cabinet and knives where accessible and observed in a kitchen drawer \302\267 Weapons are not present as stated by licensee. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 Regulations \302\267 This is a single story home \302\267 Clean, safe and age appropriate toys are observed in and out of the facility. \302\267 There is a roster on file, however the roster is not current \302\267Facility Sketch, Emergency Disaster Plan and Notification of Parent\342\200\231s Rights were not visibly posted \302\267 Documentation of fire and disaster drills is not on file \342\200\223 Last drill conducted and documented was 04/04/2019, however, licensee states she conducted a drill some time before summer this year. The facility does not have any bodies of water. Licensee understands all bodies of water including ponds, above ground pools & spas, in-ground pools & spas, and some fountains must be properly covered or fenced per Title 22 Regulations. The Department must be notified before and after installation of the above types of bodies of water. In addition, all wading pools or similar product must be emptied immediately after use and stored in an upright position. \302\267 Verification of control of property on file \302\267 Children\342\200\231s records were missing documents \302\267 Employee records were complete \302\267 Licensee has not completed Mandated Reporter Training \302\267 Pediatric CPR and First Aid Card expire on 08/2023 \302\267 Health & Safety Certificate was completed on 04/25/2015 \302\267 Resident and/or staff records reviewed on 08/09/2022, indicate that all adults who require caregiver background checks have received all required clearances or exemption. -The LICENSEE, Denia Diaz confirmed that there are no Registered Sex Offenders living in the facility and/or using the facility address for their mailing address. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm -The Licensee was informed of their reporting requirements and was provided with the Regional Office\342\200\231s Unusual Incident Reporting email mailbox: UnusualIncidentReportsDO10@dss.ca.gov -The Licensee can submit transfer forms to associate new individuals or to disassociate someone from the facility at: Associations_Disassociations858@dss.ca.gov - LPA's discussed the safe sleep regulations with licensee, Denia Diaz and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. - Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. - Go to the licensing webpage www.ccld.ca.gov , and click on the \342\200\234Receive Important Updates\342\200\235 located on the right side of the page, immediately above the Quick Links. One can add their email address and choose which program(s) they wish to receive Provider Information Notices (PIN) for. - The Duty Officer is available to answer questions Monday \342\200\223 Friday; 8:00am to 5:00pm at: 1-844-LET-US-NO (1-844-538-8766) and/or 951-782-4200. There was deficiencies issued at this time, please see deficiency pages for cited violations. Technical Assistance (LIC 9102TA) and Technical Violations (LIC TV) were also issued.     Based on observation and interview, the licensee did not comply with the section cited above which poses, due to a carbon monoxide detector being observed in the home, however it was not installed and had no batteries. In addition, there were two smoke detectors observed and one was not in working order and appeared to need battery replacement , which poses a potential health, safety or personal rights risk to persons in care.
