What the inspector wrote

On August 22, 2024, Licensing Program Analysts (LPAs) Cindy Hamilton and Brian Morris conducted an unannounced case management visit to Ortega Trail Youth Centers. LPA met with Director, advised the Director of the purpose for the visit, conducted a tour of the facility and took census of staff and students. During an investigation of Complaint Control # 10-CC-20240524143147, it was observed that current staff did not meet the personnel requirements set forth in Title 22 or Health and Safety Code. LPA conducted staff records reviews on June 3rd and June 26, 2024, and observed that staff did not have the correct First-Aid/CPR and Mandated Reporter certifications on file. It was also observed on June 26, 2024, that a staff was alone with 13 children without the required certifications and documentation required by Title 22 and they are not qualified to supervise children on their own. Based on records review, the center did not comply with the Health and Safety Code (HSC), and is being cited for the following: HSC Section 1596.8662(b)(1) Availability of information regarding detecting and reporting child abuse and neglect; training form mandated reporter who is licensed day care provider, administrator, or employee of a licensed child care facility; proof of completion. In addition, the center did not comply with Title 22, Section 101216(f) Personnel Requirements. The facility is being issued two Type B citations in reference to not complying with the above sections, see LIC 809D. An exit interview was conducted, Director was provided a copy of this report, discussed appeal rights and provided the Notice of Site Visit. Director was reminded that Notice of Site Visit must remain posted for 30 consecutive days .

This requirement was not met as evidenced by: Based on records review S2 and S3 did not have certificates for the trainings to substitute units or, Early Childhood Education or Child Development units. Director had a letter from Sycamore Academy stating S2 and S3 had completed the substitute trainings.

    101216(f) Personnel Requirements:(f)At least one staff member who is trained in pediatric cardiopulmonary resuscitation and pediatric first aid pursuant to Health ... shall be present when children are at the childcare center or offsite...This requirement was not met as evidenced by: On June 26, 2024, LPA Hamilton observed a staff without Pediatric First-Aid/CPR certification providing care and supervision for 13 children which poses a potential health, safety and/or personal rights risk to children in care.

  • ARTICLE 2. Administration of Child Day Care Licensing

    HSC 1596.8662(b)(1):(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a) and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: S2 and S3 did not complete the required Mandated Reporter Training and first aid/CPR for childcare providers which poses a potential health, safety and/or personal rights risk to children in care.
