What the inspector wrote

Based on LPA\342\200\231s observations, interviews and evidence collected the preponderance of evidence has been met and the allegation of Personal Rights- Licensee covered infants face with a blanket and Children are left in a high chair for an extended period of time while in care is substantiated. The facility is being cited with Title 22, violation of Personal Rights, which poses an immediate risk to children in care. An exit interview is conducted, copy of report, LIC9099D and appeal rights were provided to Beatriz Cota. The report was reviewed and discussed, with Mrs. Cota. The facility representative was informed that the \342\200\234Notice of Site Visit\342\200\235 must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The \342\200\234Notice of Site Visit\342\200\235 must be posted on or adjacent to the door. Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00. If the facility receives a Type A violations, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day, and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child\342\200\231s file.

    PersonaL Rights. Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. To be treated with dignity in his/her personal relationship with staff and other persons. This requirements was not met by evidence by pictures provided showed a child while at the facility with a blanket over child's face in addition to interviews conducted revealing that children in care are often seen with blanket over there faces. This is an immediate risk to the health and safety of children in care.

To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This requirement was not met by evidence by LPAs observation and interviews with relevant parties revealed that the Licensee places infants and younger children regularly in swings and high chairs for extended periods of time.
