What the inspector wrote

Interview with S2 disclosed that he has not really been smoking lately, but that it is mostly him that smokes marijuana. S2 admitted to smoking in the past, stating that the garage and back yard are marked off limits to children in care. Confidential interview disclosed observation of a bong in the room to the right of the front door and that A1’s children would talk about S1, S2 being in the garage for a long time, while the children were there. It was reported that S1 has used her vape in front of the children in care. Based on confidential interviews and LPA’s observations the preponderance of evidence has been met and the allegation that licensee allows adults in the home smoke marijuana at the day care home is substantiated. This poses an immediate health, safety, or personal rights risk to children in care. See LIC 9099D for citation issued for deficiency. If the facility receives a Type A violation, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days, and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file. The licensee was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door. Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00 Confidential interviews revealed that licensee has left the children in care alone with S2, while S1 was lying in bed or getting ready to watch the children in care. File review disclosed that S2 is not allowed to be alone with children care unsupervised. Interview with S2 denied ever being alone with children in care. Other confidential interviews denied any concerns with the children in care of the FCC. Another allegation was received that the licensee was under the influence at the day care home. It was reported that S1, and S2 were under the influence of marijuana and alcohol while providing care to children. Interview with S1 denied allegation of being under the influence of any drugs or alcohol while children care in care. Other reports revealed that S1 will smoke a vape pen in the living room, with children in care. Other confidential interview denied any observation of S1 or S2 being under the influence of any drugs or alcohol while children are in care. Interview with S2 admitted to rarely smoking marijuana, but not while children are in care. Other confidential interviews disclosed no observation of S1, S2 under the influence of drugs or alcohol with children in care. An additional allegation was received that licensee does not provide a safe environment for day care children. It was reported that licensee allows men walking in and out of the house through the garage to the back door, never the front door. Interview with licensee denied allegation that other adults are ever in the home while children are in care. Confidential interview disclosed observing other male adults in the FCC while children are in care. Other confidential interviews revealed no observation of other adults in the home other than S1, S2 while children are in care. Interview with S2 denied allegation of having other adults in the home while children are in care. Based on confidential interviews & lack of collaboration from reporting party, the allegations that Uncleared adult providing care and supervision to day care children, licensee was under the influence at the day care home and licensee does not provide a safe environment for day care children, may have occurred, however, are not supported or proven by evidence. Therefore, the allegations are unsubstantiated. Exit interview was conducted and a copy of this report, appeal rights and Notice of Site Visit were provided to licensee, Emma Sanders. The licensee was informed that the Notice of Site Visit must remain posted for 30 days.

Based on confidential interviews, LPA’s observation on 10/05/23, and admission from staff #2 (S2), the allegation that licensee allows other adults to smoke in the family childcare and gate for the kitchen making it inaccessible to children in care was observed on 10/05/23. This poses an immediate, health, safety, and personal rights risk to children in care.
