What the inspector wrote

On the date and time listed, Licensing Program Analysts (LPAs) Perla Ordones and Samuel Lopez arrived at the facility for the purposes of conducting a case management inspection regarding the outside patios which was disclosed to the department to have been installed without permit(s). Licensee submitted an application for an increase in capacity which was also addressed during the visit. LPAs toured the facility, inside and out, records were reviewed, and the following was observed and/or discussed: Normal days and hours of operation are: Monday \342\200\223 Friday; 06:00AM \342\200\223 06:00PM. OFF-LIMIT AREAS INCLUDE: Entire second floor, garage, side patios, and the backyard. During this visit, LPAs inspected the right hand patio area where Licensee indicated children play outside. In the outside patio, which is located to the right of the home, LPAs observed several plastic play structures, several ridable toy cars, and other children\342\200\231s toys outside. Also, prior to entering the facility, children could be heard playing outside, underneath the patio. LPAs asked Licensee if they had the required permits on file for the patio structure. Licensee stated that they did not have the required permits. Due to Licensee not having the required permits necessary for the patio structure, the on-limits patio area poses an immediate risk to children in care. Licensee agreed to make the patios off-limits until the required permits were obtained. Licensee submitted a new facility sketch to LPAs. \302\267 The facility is operating within the licensed capacity and appropriate ratios. \302\267 Appropriate fire extinguisher, smoke detector and carbon monoxide detector are present and were tested by the Licensee during this inspection. Fire extinguisher, smoke detector and carbon monoxide detector are in working order. \302\267 All hazardous items are inaccessible. \302\267 Storage of poisons/toxins are inaccessible to children and locked. \302\267 Weapons are not present. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 Regulations. \302\267 The Licensee provided proof of control of property. \302\267 Facility Sketch and Emergency Disaster Plan are posted. Licensee has decided to make a previously off-limits area, the den, on-limits during this inspection. \302\267 An in-ground pool is present that has a five-foot-tall mesh type fence that surrounds the in-ground pool. Additionally, fencing contains a gate with a self-latching and self-closing door, which swings away from the pool. \302\267 Documentation of fire and disaster drills on file \342\200\223 Last drill conducted on 01/10/2024. \302\267 Clean, safe and age-appropriate toys. \302\267 There are no toxic plants observed at this time. Resident and/or staff records reviewed on 03/04/2024 indicate that all adults who require caregiver background checks have NOT received all required clearances or exemptions as Licensee stated their adult child resides in the home but LPAs observed that there was no criminal record clearance for the individual. Licensee was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. Before licensure, the following needs to be corrected/completed: - Permits must be obtained if licensee would like to use the patio covered area for outdoor play - Adult child must obtain criminal record clearance - Plan of correction for citations issued Once all corrections have been verified, the application for a Large Family Child Care Home will be submitted for approval with a maximum capacity of 12, or 14 with parent notification/assistant present. Applicant advised that all corrections are due within 30 days or the application may be withdrawn. On this date, 03/04/2024, the California Attorney General - Megan\342\200\231s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. A Civil Penalty has been assessed during this inspection. Payment is due when billed and the check(s) or money orders shall be made payable to the \342\200\234California Department of Social Services\342\200\235. YOU WILL RECEIVE AN INVOICE IN THE MAIL. DO NOT SEND MONEY UNTIL YOU RECEIVE YOUR INVOICE. DO NOT SEND CASH. See LIC809-D for cited deficiencies. LPA Perla Ordones and Samuel Lopez informed licensee Sally De La Paz that this report dated 03/04/2024 document(s) two Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Perla Ordones and Samuel Lopez informed licensee Sally De La Paz to provide a copy of this licensing report dated 03/04/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given to licensee and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Exit interview conducted and report was reviewed with the Licensee Sally De La Paz.
