What the inspector wrote

There was conflicting information received during the investigation from what was alleged. This agency has investigated the complaint alleging a teacher yelled at daycare children. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. The following was alleged: Teacher did not give a child food as punishment LPA obtained clarification of the alleged allegation prior to making contact with the facility. On 01/25/2022, LPA made an unannounced visit to the facility and conducted interviews with three children and six staff. All staff interviewed deny the allegation a teacher did not give a child food as punishment. Staff stated the facility provides snacks and lunch as part of its program curriculum. In addition to providing food, children often bring personal snacks to school in their backpacks/lunch bags to supplement what is provided by the facility. Staff stated children often request snacks or attempt to retrieve snacks from their backpacks/lunch bags during instructional and non-eating periods, which can cause a disruption in the classroom. Staff stated children can eat their snacks at designated times, food is never withheld as a form of punishment. Children interviewed denied food being withheld from staff. There was conflicting information received during the investigation from what was alleged. This agency has investigated the complaint alleging a teacher did not give a child food as punishment. Although the allegation may have happened, or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. No deficiencies cited A NOTICE OF SITE VISIT WAS GIVEN. DIRECTOR WAS INSTRUCTED TO POSTED IT IN A PROMINENT LOCATION AT THE FACILITY. THE DIRECTOR UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS. An exit interview was conducted, A copy of this report and appeal rights were given to the Director during this inspection on 03/14/2022

    Reporting Requirements - Any unusual incident or child absence that threatens the physical or emotional health or safety of a child shall be reported to the Department within 24 hours of the occurrence.This requirement has not been met as evidenced by: Based on interviews conducted with staff on 02/14/2022, LPA discovered the facility had knowledge of an unusual incident which occured on 01/28/22 regarding a day-care child biting another day-care child and failed to report it to Licensing. This poses a potential risk to the health and safety of children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    Responsibility for Providing Care and Supervision - No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation.This requirement has not been met as evidenced by: Based on Interviews and records reviewed, on 01/26/2022 Staff left a child in the Facility's restroom unattended. On 02/03/2022 Staff left a child unattended while transitioning other children from one classroom to another. This poses an immediate health and safety risk to the children in care.
