What the inspector wrote

Licensing Program Analysts (LPAs) Ana Noble and Jeanette Sanchez arrived at the facility on a case management inspection to follow-up on an Unusual Incident Report (UIR) which occurred on March 2, 2023. At the time of inspection, LPA toured the facility, took census, interviewed and met with Maria Reyes, Licensee to discuss the purpose of the visit. The reported incident took place on March 2, 2023, Licensee self reported that on this date at approximately 8:00 am, the son who is the assistant left to drop off children at school. At approximately 8:10 am the Migrant Program arrived and noticed Licensee was alone with a total of 11 children. During todays inspection the Licensee informed LPA that on March 2, 2023 at approximately 8:00 am -8:10 am, her son who is the assistant, left to drop off children at school. At which time an additional 3 children arrived, causing Licensee to be out of ratio. Once the 3 additional children arrived the Licensee was present alone with a total of 11 daycare children. At which time the Migrant Program arrived and advised that Licensee that she was out of compliance. After review of submitted facility documentation and interviews conducted, there is a violation of Title 22 Regulations pertaining to this unusual incident reported to the department on March 2, 2023. See LIC809-D for cited deficiencies. An exit interview was conducted with Maria Reyes, Licensee. Appeal rights discussed and a copy of this report was provided.

    Staffing Ratio and Capacity - If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). On 3/2/23, Licensee was alone with a total of 11 children for approximately 10 minutes, while assistant dropped off children at school.
