Inspector’s narrative

What the inspector wrote

The Licensing Program Analyst (LPA) Samuel Lopez investigated the above allegation and the following was gathered: In the course of the investigation it was learned that a parent arrived at the facility, to pick up their child, accompanied by local law enforcement. However, the licensee refused to release the child. Per licensee’s own admission, a court order outlining custody details between both parents, had been obtained, prior to the child’s enrollment. The licensee was aware of the days and times that each parent had custody or visitation rights to. On the date and time in question, the parent that arrived to pick up their child, had legal right to do so. No current or new legal documents had been provided stating that custody had been revoked for any of the parents. The licensee knowing this information still waited between 20 to 30 minutes before re-reviewing the court order and releasing the child. Based on licensee’s own admission, interviews conducted, and a review of additional pertinent information obtained, the preponderance of evidence standard has been met, therefore the above allegation regarding the licensee not following a court order, is found to be Substantiated. See LIC 9099-D for cited deficiency An exit interview was held, and a copy of this report was sent, via email, to Yasmin Ledesma-Perez. ***This report was sent via email on 3/22/2021. • 102419(a)(6)Type B

Admission Procedures and Parental and Authorized Representative's Rights: To request in writing that a parent not be allowed to visit a child or take a child from the family child care home, provided the custodial parent has shown a certified copy of a court order pursuant to Health and Safety Code Section 1596.857. This requirement was not being met as evidenced by the licensee’s refusal to allow a parent to take their child, without any prior written legal documentation stating that the parent had no legal right to do so. This poses a potential Health, Safety or Personal Rights risk to the children in care.

  • REPORTING REQUIREMENTS

Reporting Requirement: The licensee shall report to the Department any of the events as specified in Health and Safety Code Sections 1597.467(b)(1)(A) through (b)(3)(C) that occur during the operation of the family childcare home. This requirement was not being met as evidenced by the licensee’s failure to report verbally and in writing, via the Unusual Incident Report form (LIC624B), the incident involving law enforcement's visit during a custody dispute with a parent. This poses a potential Health, Safety or Personal Rights risk to the children in care.
