Admission Procedures and Parental and Authorized Representative's Rights: To request in writing that a parent not be allowed to visit a child or take a child from the family child care home, provided the custodial parent has shown a certified copy of a court order pursuant to Health and Safety Code Section 1596.857. This requirement was not being met as evidenced by the licensee’s refusal to allow a parent to take their child, without any prior written legal documentation stating that the parent had no legal right to do so. This poses a potential Health, Safety or Personal Rights risk to the children in care.

Reporting Requirement: The licensee shall report to the Department any of the events as specified in Health and Safety Code Sections 1597.467(b)(1)(A) through (b)(3)(C) that occur during the operation of the family childcare home. This requirement was not being met as evidenced by the licensee’s failure to report verbally and in writing, via the Unusual Incident Report form (LIC624B), the incident involving law enforcement's visit during a custody dispute with a parent. This poses a potential Health, Safety or Personal Rights risk to the children in care.
