What the inspector wrote

On 06/17/2025 at 01:25 PM, Licensing Program Analyst (LPA) Raymond Moorehead arrived at the facility to conduct a case management inspection. LPA met with Director Gloria Luna. A case management inspection was conducted in response to the receipt of an follow up Unusual Incident Report (UIR) from the facility. The UIR was received by the licensing agency on 06/12/2025. The UIR documented an incident where a child reported to their parents that they were allegedly slapped by a teacher in the office of the facility. This was a self reported incident, and the facility's staff members have stated that the allegation did not happen at the facility. LPA investigated the incident, and pertinent interviews were conducted. The following was disclosed. Staff interviews disclosed a incident where the subject child was throwing sand while playing in the sandbox. It was stated that the sand being thrown by the subject child was landing on other children. Then, it was stated that a teacher asked the subject child to stop throwing sand, or else they would have to either play on the play structure or play in the grass. Further, it was reported that the subject child threw sand at the teacher and it hit them in the eye. Director stated that she went outside to talk to the subject child and had them apologize to the teacher for throwing sand in their face. It was reported that this specific incident took place on 06/02/2025. It was also reported that the facility was informed of the allegation by the parent on 06/03/2025. The facility initially reported the incident to the Department on 06/03/2025. An additional UIR was received from the facility on 06/12/2025 with further details of a proceeding incident regarding a parent's aggressive behaviors. Continued on LIC 809-C. During today's visit, LPA conducted pertinent staff interviews. All staff interviews consistently denied any allegation of a child being slapped while in care at the facility. Further, all staff interviews consistently stated that they have not witnessed any teacher slapping a child. It was also consistently stated that all teachers are trained to not touch children for any disciplinary issues. All staff interviews stated that children are not aware of the facility's office and never go into the facility's office. Staff interviews also disclosed that the subject child did not specify a teacher that was responsible for the alleged slapping. Based on the information obtained, there appeared to be no violations of Title 22 Regulations pertaining to the reported incident at this time. LPA conducted an exit interview with Director Gloria Luna, and provided a copy of this report. A Notice of Site Visit was issued and must remain posted for the next 30 days. No deficiencies were cited during today's inspection.
