What the inspector wrote

On date and time listed, Licensing Program Analyst (LPA) Chase Atherton arrived at the facility to conduct an annual inspection and an inspection for a change of capacity. LPA toured the facility, inside and out, records were reviewed, and the following was observed and/or discussed: \342\200\242 Normal days and hours of operation are: Monday - Friday, 6am - 5pm \342\200\242 Off-limit areas include: The 1st Floor Laundry room, Garage, Entire 2nd Floor, and a large portion of the backyard. \342\200\242 Only 1 licensee is present in the home which does not comply with Title 22 regulations. During the hours of operation, a licensee is permitted to have a temporary absence no longer than 20 percent of the hours of operation, daily. SEE LIC809D for deficiency cited. \342\200\242 The facility is licensed to have no more than 8 children as a small FCCH and is operating within the licensed capacity and appropriate ratios. \342\200\242 Appropriate supervision was being provided during this inspection \342\200\242 A working telephone is present, and the current phone number is on file. Cell \342\200\242 A fully charged fire extinguisher (2A:10BC) was observed. A smoke detector and carbon monoxide detector were present and tested by the Licensee during this inspection. \342\200\242 Fireplace is properly screened to prevent access by children - glass screens \342\200\242 All hazardous items are stored inaccessible to children \342\200\242 Toxins are locked and inaccessible to children in care. \342\200\242 Weapons are not present as stated by the licensee. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 Regulations. \342\200\242 Stairs are barricaded \342\200\242 Clean, safe and age appropriate toys are provided \342\200\242 Current roster NOT on file. There is also one Advisory Note issued related to the roster. This is NOT a deficiency. SEE LIC9102TV for Advisory Note issued. \342\200\242 Facility Sketch, Emergency Disaster Plan and Notification of Parent\342\200\231s Rights poster are posted \342\200\242 Documentation of fire and disaster drills are on file \342\200\223 Last drill was conducted 2/2025. The date of the last fire drill is more than 6 months ago, which does not comply with Title 22 regulations. SEE LIC809D for deficiency cited. \342\200\242 No bodies of water at this time. Licensee understands all bodies of water including ponds, above ground pools & spas, in-ground pools & spas, and some fountains must be properly covered or fenced per Title 22 Regulations. The Department must be notified before and after installation of the above types of bodies of water. In addition, all wading pools or similar product must be emptied immediately after use and stored in an upright position. \342\200\242 Verification of control of property is on file \342\200\242 Children\342\200\231s records are complete \342\200\242 Employee\342\200\231s records are complete \342\200\242 Mandated Reporter Training completed and expires on 11/2025 \342\200\242 Pediatric CPR and First Aid Card EXPIRED on 9/4/2025. This does not comply with Title 22 regulations. SEE LIC809D for deficiency cited. \342\200\242 Health & Safety Certificate - completed and on file. \342\200\242 Resident and/or staff records were reviewed and all adults who require caregiver background checks have received all required clearances and/or exemptions. Facility representative was reminded that all adults 18 and over, living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with licensee [or facility representative] and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. - There is one deficiency related to safe sleep requirements. Based on record review and interview, the licensee did not conduct or document safe sleep checks for infants (younger than 2 years old) every 15 minutes for Child 1 (C1) while the child was asleep. This does not comply with Title 22 requirements. SEE LIC809D for deficiency cited. - There is also one Advisory Note issued related to safe sleep regarding the presence of cribs for differently aged infants. This is NOT a deficiency. SEE LIC9102TV for Advisory Note issued. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. On-line Licensing forms & regulations for a Child Care Center can be obtained on the Department\342\200\231s website: www.ccld.ca.gov . Additionally, there is a link to \342\200\234Receive Important Updates\342\200\235 located on the right side of the page, immediately above Quick Links. One can add their email address and choose which program(s) they wish to receive Provider Information Notices (PIN) for. The Duty Officer is available to answer questions Monday \342\200\223 Friday; 8:00am to 5:00pm at: 1-844-LET-US-NO (1-844-538-8766) and/or 951-782-4200 The licensee has applied to increase their capacity to that of a Large Family Child Care Home. Fire Clearance was approved 8/15/2025. Once all corrections have been made, with proof sent to licensing, the application for a Large Family Child Care Home will be submitted for approval with a maximum capacity of 12, or 14 with parent notification. As agreed upon by the licensee, all corrections are due within 30 days. If not received within 30 days from the date of this report, the application may be withdrawn, and the license will remain a Small Family Child Care Home. See LIC809D for cited deficiencies. During the exit interview, the facility representative Emily Hernandez, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. A notice of site visit was given and must remain posted for 30 days. An exit interview was conducted, and this report was reviewed with the licensee facility representative Emily Hernandez. Appeal rights were discussed and provided during the exit interview.

    Based on interview and observation, the licensee did not comply with the section cited above in Staff 2 (S2) was not present at the facility and their temporary absence is ongoing since 9/4/2025 and will continue until 9/13/2025. This licensee is temporary absence exceeded more than 20 percent of the hours that the facility is providing care per day. This poses/posed a potential health, safety or personal rights risk to persons in care.

  • OPERATION OF A FAMILY CHILD CARE HOME

    Based on record review and interview, the licensee did not comply with the section cited above in the last conducted fire drill was in February of 2025, which is more than 6 months before today's date. This poses/posed a potential health, safety or personal rights risk to persons in care.

  • INFANT SAFE SLEEP

    Based on record review and interview, the licensee did not comply with the section cited above in that the licensee did not check on Child 1 (C1) every 15 minutes while they were sleeping, which poses/posed a potential health, safety or personal rights risk to persons in care.
