What the inspector wrote

On the date and time listed, Licensing Program Analysts (LPAs) Perla Ordones and Eric Ramos arrived at the facility for the purposes of concluding a follow up Case Management inspection which was initially conducted on 08/26/2024 in response to the receipt of an Unusual Incident Report (UIR) that was submitted by the facility. The UIR was received by the licensing agency on 08/22/2024. LPA was granted entrance into the facility by Director Rosa Perez. LPA explained the purpose of the visit and conducted a facility tour to take census. The UIR documents an incident wherein a day-care child was left alone in the Preschool 2 classroom and was found by their grandmother. LPA toured the entire facility and LPA also obtained documentation relevant to the UIR. LPA reviewed video footage of the incident and observed that the day-care child was left alone for approximately three minutes. LPA conducted interviews with pertinent parties who stated they witnessed the day-care child left alone in the classroom and stated that the child appeared “scared”. Other pertinent parties stated that the staff did not see that the day-care child did not follow the rest of the class as they made their way towards the playground and only noticed the day-care child was missing as they approached the director’s office. Director stated that the lead teacher of the classroom had left the child alone in the classroom while they went to the Director’s office to ask for help. Director stated that staff are given walkie talkies to communicate with the Director and other staff to ask for help but that the lead teacher was new and decided not to use it. Based on the observations made and information gathered, this incident is a violation of Title 22 101229 – Responsibility for Providing Care and Supervision. Civil Penalty has been assessed during this inspection. Payment is due when billed and the check(s) or money orders shall be made payable to the “California Department of Social Services”. YOU WILL RECEIVE AN INVOICE IN THE MAIL. DO NOT SEND MONEY UNTIL YOU RECEIVE YOUR INVOICE. DO NOT SEND CASH. See LIC809-D for cited deficiency. LPAs Perla Ordones and Eric Ramos informed Director Rosa Perez that this report dated 10/25/2024 document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPAs Perla Ordones and Eric Ramos informed the Director Rosa Perez to provide a copy of this licensing report dated 10/25/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the Director Rosa Perez.

    (a) The licensee shall provide care and supervision...(1) No child(ren) shall be left without the supervision of a teacher at any time…This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above as a child was left alone inside the classroom for approximately three minutes which poses an immediate health, safety or personal rights risk to persons in care.
