What the inspector wrote
On date and time listed, Licensing Program Analyst (LPA) Samuel Lopez arrived at the facility to conduct a pre-licensing inspection. The applicant has submitted an application for re-location from the currently licensed facility (334846262). Required fire clearance was granted on 9/4/2024.
Present during this inspection were: Rosa Lopez Chavez and Spouse Saul Herrera. LPA toured the facility, inside and out and the following was observed and/or discussed:
Normal days and hours of operation are: Monday through Saturday, 5:00am to 12:00am

The home is tri-level. The entrance is on the second floor. The facility will operate in the lower level floor and will use one restroom on the top floor. Stairs are barricaded at all levels.

Because the applicant rents/leases the home, proof of landlord notification is required. The LPA observed the Property Owner/Landlord Notification form (LIC9151) that the applicant confirms was provided to the property owner/landlord. The applicant obtained a signed Property Owner/Landlord Consent form (LIC 9149).

There is an in-ground pool that is partially fenced with wrought iron, which is over five feet high, and the other part with cinder block. It also has a wrought iron gate/door that swings away from the pool and is self latching/closing. However, LPA observed a sliding window with direct access to the pool that will need to be addressed in order to eliminate the direct pool access. Also, there is a door on the garage with access to the outside and the pool as well. This access to be eliminated as well.

- Responsibility to know the regulations for anyone providing care
- Inaccessibility of hazards must be constantly reassessed depending on the children in care
- Current facility\342\200\231s phone numbers must always be on file with the licensing office
- Baby walkers, baby-bouncer, and walker-jumpers are prohibited (16 CFR 1500.86(a)(4))
LPA reviewed with Rosa Lopez Chavez the LIC 311D, Forms/Records to Keep In Your Family Child Care Homes, children\342\200\231s forms/records, facility forms/records, and information to be posted. Entrance Checklist was provided to the applicant.
LPA discussed the safe sleep regulations with Applicant Rosa Lopez Chavez and discussed the Child Care Licensing Safe Sleep webpage at:

as an additional resource.
LPA also informed Applicant Rosa Lopez Chavez of the importance of checking for recalled infant/child devices on the United States Consumer Product Safety Commission (CPSC) website at:

and recommended they register all infant/child devices with the CPSC to be notified of any recalls on their purchased equipment.

Rosa Lopez Chavez was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

Rosa Lopez Chavez was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Before licensure, the following needs to be corrected/completed:
1. Eliminate access to the pool from the master bedroom window and garage door that leads to the outside of the back yard, and onto the pool.
Once all corrections have been made, LPA will return for verification, and after final review by the Department/Agency, the application for a Large Family Child Care Home will be submitted for approval with a maximum capacity of 12, or 14 with parent notification. As agreed, upon by the licensee, all corrections are due within 30 days. If not received within 30 days from the date of this report, the application may be withdrawn.
On this date, 8/20/2024, the California Attorney General - Megan\342\200\231s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.
