What the inspector wrote

Regarding the allegation that facility staff did not provide adequate supervision of children in care and facility staff did not provide day care child's authorized representatives with incident reports, it was alleged that C1 scratched and punched C2, bit C3, and \342\200\234spit\342\200\235 on and pushed other children and incident reports were not provided to parents. Confidential interviews with staff revealed that staff had not seen C1 scratch C2 nor did C2 indicate they were scratched at the CCC. Alleged scratch marks on C2 were shown to staff the day after the alleged incident, however, interviews with staff revealed the scratches appeared to be old and were located under C2\342\200\231s shirt. Regarding C1 allegedly biting C3, the interview with C3 did not reveal C3 was bit by C1 and there was no mark observed at the time of the alleged bite. The interview with C4 revealed C4 was not hurt by C1 and C1 did not hurt any other children. The interviews with C3 and C5 revealed C1 had pushed and/or hit them, as well as other children, however specific details could not be provided. The interviews with children indicated staff were present during some incidents and not present during some incidents. Regarding C1 spitting, interviews with staff revealed that C1 \342\200\234spit\342\200\235 at children, however, both staff demonstrated and detailed C1\342\200\231s spitting as sticking their tongue out and blowing. Staff interviews further revealed staff had not observed C1 to bite, hit, kick, or punch any children, therefore no incident reports were written. Record review revealed incident reports were written in other instances where C1 was observed to pick up children. Further record review revealed that in August 2023, although not observed by staff, an incident report was documented for C2, C3 and C4 after the CCC was made aware the children told their parents they were hit by C1. An interview with one parent revealed they believed C1 acted maliciously and believed there were no staff present when alleged incidents with their child and other children occurred, while another parent interview revealed their child had not been hurt or injured by C1 and they had no concern of supervision at the CCC. Regarding the allegation that facility is operating out of ratio, interviews revealed that the facility does not have an issue with staffing or remaining in ratio in the Kinder class or any other class. Interviews with children revealed that two staff in addition to the teacher assist in the Kinder class throughout the day. Additionally, each time LPA visited the facility, the Kinder class as well as other classes were in ratio. Based on confidential interviews conducted and conflicting statements, the allegations that facility staff did not provide adequate supervision of children in care, facility staff did not provide day care child's authorized representatives with incident reports and facility is operating out of ratio, may have occurred, however is not supported or proven by evidence. Therefore, the above allegations are unsubstantiated. An exit interview was conducted and a copy of this report and appeal rights were discussed and provided to Licensee George Garcia. A notice of site visit was also provided and must remain posted for 30 days.
