Inspector’s narrative

What the inspector wrote

Licensee stated nine children are enrolled regularly and record review revealed nine children attend regularly and three additional drop in children are enrolled as well. LPA observed the facility to be operating out of ratio at this time. Based on observation and record review conducted during the investigation, the preponderance of evidence standard has been met and the allegation that licensee operated out of ratio is substantiated. The facility is being cited for Title 22 Regulations Section 102416.5 (e) Staffing Ratio and Capacity. See LIC 9099-D for cited deficiencies. An exit interview was conducted, appeal rights were discussed and provided to the licensee Sherryl Gomes along with a copy of this report. A notice of site visit was also provided and must remain posted for 30 days.

    STAFFING RATIO AND CAPACITY

    (e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). This requirement was not met as evidenced by: Based on LPA observations of seven children in care, three of whom are infants with no assistant present, which poses a potential health, safety and/or personal rights risk to children in care.
