What the inspector wrote

Based on confidential interviews and observation conducted during the investigation, Licensee is not ensuring the inaccessibility of pool(s) by surrounding the pool with a fence, that obstructs the view of the pool and has a mesh fence that does not have a self latching gate and does meet Title 22 requirements therefore the preponderance of evidence standard has been met and the allegations are substantiated. The Licensee will be cited a deficiency and a $500 Civil Penalty will be assessed. A copy of this report and appeal rights were given and explained to Licensee Audrey Millar.

Based on observation and interviews licensee did not comply with title 22 regulations with a properly barricaded fence surrounding the pool with a self latching gate, this poses an immediate risk to the health and safety of children in care.
