What the inspector wrote

On 06/29/2022 Licensing Program Analyst (LPA) Susan Brewer, arrived at the facility unannounced for purpose of conducting a Case Management Inspection, at the licensee's request to inspect a newly installed in-ground pool and fencing. LPA was greeted by the Licensee Bianca Harris, conducted a Covid-19 pre-screening and granted entry into the home. Present were the licensee, 3 adults and 6 children, the licensee is not operating on today's date. The following was discussed during the inspection: A census was taken of 0 daycare children in care. A change was made to the off limit area of back yard area, which is now open to daycare children.. Normal days and hours of operation are: Mon-Fri, 7:30 AM to 4:00 PM OFF-LIMIT AREAS INCLUDE: Entire 2nd Floor, 1st Floor Garage, Recreation room and Bedroom 4, Outside: Pool Area, West side yard and East side yard where dog run is located. LPA S.Brewer inspected the fence to be fully surrounded by fencing which consisted of installed mesh panels. LPA took measurements and obtained photographs of the pool for verification of compliance with Title 22 regulation 102417, regarding Large Bodies of Water. Fence is not easily climbable by children. No window or door provides access to the pool. Opening between railings does not exceed 4 inches, nor does the bottom of the fence from the ground on hard surface. Horizontal railings are at least 45 inches apart. Fencing is thick enough that it cannot easily be broken, removed or stretched by children. Gates swing away from the pool, self-close and are self-latching and self-latch is no more that six inches from the top of the gate. Fence is designed and installed so children are unable to remove any portion of it. The licensee Bianca Harris, agrees that the fencing will remain in place whenever licensed care is provided, and so long as the mesh fence makes the swimming pool inaccessible to children as determined by licensing staff. Additional safety latches were installed to the sliding back window to prevent children from gaining access to the outdoor area from the daycare room. Licensee Bianca Harris confirmed there are no registered sex offenders receiving mail at the facility and was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted with Licensee Bianca Harris, report was reviewed and a copy was provided to the licensee.
