Inspector’s narrative

What the inspector wrote

During the investigation, records were obtained and interviews were conducted. A review of records revealed there is only one staff present from 7:00 AM to 8:00 AM and from 4:30PM to 6:00PM. Six of six interviews confirmed that commingling occurs in both the morning and afternoon session, as there is only one staff member present during this time. Based on LPA observations, one staff was present with a total of six children ages thirteen (13) months to five (5) years old. Regarding the allegation that the facility is operating out of ratio, LPA observed one staff present with six children. The ages of the children ranged from thirteen (13) months to five (5) years with no assistant present, which puts the teacher out of ratio. Based on record review, interviews, and observation the preponderance of evidence standard has been met. The above allegations are found to be SUBSTANTIATED. California Code of Regulations (Title 22, Division 12 & Chapter 1) are being cited on the attached LIC 9099D. An exit interview was conducted, appeal rights discussed and given to the licensee along with a copy of this report was provided to licensee Nam De Silva. A notice of site visit was also provided and must remain posted for 30 days.

    Teacher-Child Ratio: (2): There shall be a ratio of one teacher supervising no more than 12 children…This requirement was not met as evidenced by: Based on record review, interviews, and observation one teacher was left with six children and no assistant present. The ages of the children ranged from 13 months to 5 years. Due to infants being commingled with preschool age children, ratios are being exceeded.

Four infants and 7 preschoolers were present without a fully qualified teacher.

This requirement was not met as evidenced by: Based on record review, interviews and observation staff were commingling the children from 7:00 AM to 8:00 AM and again from 4:30PM to 6:00 PM with six children present, ages 13 months to 5 years old and only one teacher.
