What the inspector wrote

On the above noted date and time Licensing Program Analyst's (LPA) Griselda Castellon and Diana Brasel conducted a unannounced case management inspection for an increase in capacity. Upon arrival LPA met with Nam De Silva, Owner. The licensee is requesting to be increase from a total capacity of 12 to a total capacity of 20 in building 1 infant room and toddler option room. 8 infants ages 0-24 months and 12 toddlers ages 18-36 months. Hours of operation will be Monday through Friday from 6 a.m. to 6 p.m. Present during today's inspection were 4 infants with 3 staff and 6 toddler option children with one staff. Appropriate ratios and supervision were observed. All indoor and outdoor activity space utilized for the children was inspected today. LPA informed Nam De Silva that staff are required to maintain direct visual supervision of the children at all times during indoor and outdoor activities. LPA continued to tour the facility and measured all indoor and outdoor activity space. Total indoor activity space measured for infant/toddler option is 864.04 sq ft, w hich is sufficient to accommodate the requested overall capacity of 20 Children LPA observed all indoor activity space to be complete with safe, age-appropriate furniture and equipment, including tables, chairs, cubbies, cribs/cots, bookshelves, and other activity supplies for the children. Infant toys are safe with no sharp edges, splinters, or points, nor made of small parts that can present a choking hazard. Drinking water is available in the classrooms via water pitchers water bottles. LPA observed all hazardous items to be inaccessible to children. There are no bodies of water or weapons on the property. A current granted fire clearance for the infant/toddler option is Pending. In the infant rooms highchairs and feeding tables have broad-based legs, plastic seats are in good repair and trays lock onto chairs. High chairs are made of washable, moisture-resistant material. Changing tables have at least 1” padding covered with moisture-resistant, washable material. Sides of the changing table are at least 3” high and the changing table is within arm’s reach of a sink. Diapering sink is not used for meal preparation or dishwashing. Cribs meet regulatory requirements. Crib area is separated from activity space via room divider. This barrier is at least four feet high, made of sound absorbing material and allows for supervision of napping children. Sleep logs are kept in each room. Needs and Services Plans and Sleep Plans are also kept in each room. LPA observed a total of 2 sinks and 2 toilets available for children’s use. The infant room(s) have at least one toilet for every five infants. These are sufficient to accommodate the requested overall capacity of 20 children . There is a separate staff restroom equipped with a toilet and a sink in the hallway in front of the kitchen area. The isolation area for children who are ill will be the office. The facility currently has a fully fenced playground area for each component . Vinyl fencing surrounding the property is at least four feet high. The total square footage for all the outdoor activity space for all components is 1220.75 sq ft, which is insufficient to accommodate the requested capacity. A playground waiver to share the playground at different times in the am and pm due to limited square footage shall be submitted and approved prior to licensure. Shade is provided via patio cover on each playground. There are sufficient outdoor age-appropriate toys and play equipment available on the playgrounds. The applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. Nam De Silva was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with the applicant and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep , as an additional resource. LPA also informed the applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/ , and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. The following correction is needed: 1. The pending fire clearance for the infant/toddler option. Exit interview conducted and report was reviewed with the Nam De Silva.

    Infant Care Center Sleeping; (1) Pacifiers shall be allowed in the crib if the following provisions are in place: (A) There shall not be anything attached to the pacifier. This requirement is not met as evidenced by LPA's observation, the licensee did not comply with the section cited above. LPA's observed a child napping in a crib with a pacifier in their mouth with an attached pacifier clip.

    Infant Care Center Sleeping: (1) Mattresses shall be firm and covered with a fitted sheet that is appropriate to the mattress size, fits tightly on the mattress, and overlaps the underside of the mattress so it cannot be dislodged. (f) Cribs shall be free from all loose articles and objects, including blankets and pillows. This requirement is not met as evidenced by LPA's observation, the licensee did not comply with the section cited above. LPA's observed a child napping in a crib without a fitted sheet, the child was laying on a loose blanket, with a blanket over the childs body.
