What the inspector wrote

licensee forces day care child to sleep in crib while in care and licensee provides child care in an unauthorized location. Regarding the allegation that licensee smokes marijuana in the presence of day care children in care, it was alleged that the licensee smokes marijuana around daycare children. Confidential interviews resulted in conflicting information being provided to LPA. Confidential witness interview disclosed that the licensee and Staff #1 were observed vaping in front of the FCCH and witness was unable to confirm if the licensee was smoking marijuana. LPA conducted pertinent interviews with staff, parents and could not corroborate allegation. Confidential interviews disclosed that licensee and S1 have never been observed smoking at all. In addition, Licensee denied the allegation and that licensee and S1 do not smoke at all. Regarding the allegation that licensee does not pick-up day-care child from school as required, it was alleged that licensee does not pick up child from school per agreement. Confidential interviews disclosed that licensee has been late to pick up child approximately four times since September 2023. Confidential interviews disclosed that S1 picks up children from school and the dates of late pick up were not provided. S1 confirmed S1 was late a few minutes to pick up the child a couple times, received a call from the school once and retrieved the child from the school office once. Licensee stated there is no written agreement with parents to pick-up children from school, usually the parent will just add licensee and S1 to the child’s emergency card on file at the school., however the dates of late pick up were not provided. Licensee stated there is no written agreement with parents to pick-up children from school and does this as a courtesy and were added to the child’s emergency card on file at the school in the event the parent was unavailable. Regarding the allegation licensee did not ensure that day care child is adequately fed while in care, it was alleged licensee is not feeding the child. Confidential interviews disclosed that when the child is picked up from FCCH, the child is crying and stating the child is hungry. Confidential interviews with children and parents disclosed that the children in care are fed breakfast and snacks after school. and have never had an issue. Confidential interviews also disclosed that the children are able to eat as much as they want and are not ever denied food. Licensee confirmed facility is no longer on the food program and all food is provided by licensee. Regarding the allegation licensee forces day care child to sleep in a crib while in care, it was alleged that a five year-old child was being forced to sleep in a crib. Confidential interviews resulted in conflicting information being provided to LPA. Confidential interviews disclosed that a child disclosed the child was being made to sleep in a crib at FCCH after school; whereas other confidential interviews disclosed children are not forced to sleep in cribs and cots are used for older children. Licensee stated there is another child who prefers to sleep in a pack-n-play and climbs into the pack-n-play on their own. During investigation, LPA conducted a tour of the home and observed several cots stored in a closet. interviews with children revealed that they would sleep on those cots and LPA could not corroborate allegation that they were forced to sleep in a crib and/or pack-n-play. Regarding allegation licensee provides childcare in an unauthorized location, it was alleged that children are being dropped off at FCCH and picked up at another day care location. Confidential interview could not confirm if other children are being taken to the other day care location. Confidential interviews also disclosed that the children at FCCH and the other day care location do not co-mingle. In addition, other confidential interview disclosed that some children are enrolled at both FCCH locations to ensure there was no violation of the daycare’s ratio and/or capacity. LPA also verified that the children would remain in the home where they were dropped off and were picked up by parents at the same location. Based on confidential interviews and record reviews, the allegations licensee smokes marijuana in the presence of day care children in care, licensee does not pick-up day-care child from school as required, licensee does not ensure that day care child is adequately fed while in care, licensee forces day care child to sleep in crib while in care and licensee provides child care in an unauthorized location. may have occurred, however are not supported or proven by evidence. Therefore, the allegations are unsubstantiated. An exit interview was conducted and a copy of this report, appeal rights and Notice of Site Visit were provided to assistant. The assistant was reminded that the Notice of Site Visit must remain posted for 30 consecutive days.
