What the inspector wrote

Licensing Program Analyst (LPA) Tricia Danielson arrived unannounced to the facility to conclude an investigation into the allegations listed above. LPA met with Licensee America Figueroa and explained the purpose of the visit. Regarding the allegation "Daycare children sustained unexplained injuries while in care", it was alleged that Child #6 (C6) sustained a bruise to the thigh while in care and Child #7 (C7) sustained a scratch on the calf while in care. Interviews conducted with staff revealed no definitive incident could be determined to cause C6's bruise or C7's scratch, nor could it be determined when or where the bruise or scratch occurred. Additionally, during an interview with a former staff, the staff reported they had never observed any staff handle C6 and/or C7 in a rough manner. Regarding the allegation "Staff mishandled daycare child", it was alleged that Licensee Figueroa dropped Child #8 (C8) while on the playground. Interviews conducted with staff indicated conflicted information. One staff denied the incident occured, one was not present, and one stated it did occur but was accidental due to an insect. Therefore, no definitive determination of a violation could be made. Although the allegations may have happened or are valid, there is no preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated. An exit interview was conducted, and this report was reviewed with and provided to Figueroa. Appeal Rights were also discussed and provided. An LIC 9213- Notice of Site Visit was also issued and must remain posted near the main entrance for 30 days. Non-compliance with posting will result in a $100 fine. This report must be accessible to the public for three years.

    Reporting Requirements- (f) The items specified in (d)(1)(A) through (H) shall also be reported to the child's authorized representative. Licensee confirmed no notice of C5's fall was provided to C5's parent or CCL. This poses a potential health, safety, and personal rights risk to children in care.

A copy of the plan shall be submitted to the Department with the license application. This requirement was not met as evidenced by: Based on record review, Licensee did not comply with the section cited above. C2's admission agreement differs from the admission agreement on file. This poses a potential health, safety, and personal rights risk to children in care.

  • MODIFICATIONS TO INFANT NEEDS AND SERVICES PLAN

    Modifications to Infant Needs and Services Plan- (a) The written infant needs and services plan shall be updated at least quarterly, or as often as necessary to assure its accuracy. This requirement was not met as evidenced by: Based on record review, the Licensee did not comply with the section cited above. C3's Infant Needs and Services Plan has not been updated since 5/15/25. This poses a potential health, safety, and personal rights risks to children in care.

  • INFANT CARE CENTER SLEEPING EQUIPMENT

    Infant Care Center Sleeping Equipment- (f) Cribs shall be free from all loose articles and objects, including blankets and pillows. This requirement was not met as evidenced by: Based on observation, the Licensee did not comply with the secion cited above. LPA observed loose articles and objects in several cribs with napping infants. This posed a potential health, safety, and personal rights risk to children in care.
