What the inspector wrote

In the video dated 03/04/21, LPA observed staff #1 covering child #1 with a blanket who was laying on a cot, then walking away. Shortly after, child #1 stands up and begins moving two potted plants located on a child size shelf next to the child\342\200\231s cot. The plants were at child\342\200\231s shoulder level and were moved towards each other very slowly, child did not appear to be in immediate danger. Staff #1 returned, grabbed child #1 by the arm, near armpit area, and laid child #1 back down on the cot. Staff #1 walks away again, child #1 stands up and tries to move the plants again. Staff #1 returns to child #1 and appears to move the child back down to the cot, Staff #1 sat between child #1 and another child and began to rub child #1\342\200\231s head in quick circular motions. Through interviews, LPA learned that staff #1 handles children in a rough manner and speaks to children in a mean and frightening tone at times. Furthermore, LPA learned that there have been other staff who are no longer employed at the facility who have mishandled children as well. Site Supervisor stated that she has given verbal warnings to staff about proper handling of children and upper management conducted training to correct the interaction between staff and children. Based upon evidence obtained through video surveillance and interviews, there is a preponderance of evidence to support the allegation; therefore, the finding is SUBSTANTIATED. Title 22 deficiency is cited on the subsequent page of this report (LIC809D). Program Director acknowledges, that for TYPE A DEFICIENCIES ONLY upon receipt, facility staff shall post LIC9099-D with Type A deficiency for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the Program Director. This report was reviewed with the Program Director and Center Manager. Report, appeal rights, LIC9224, and notice of site visit will be delivered electronically to Program Director via email. Acknowledgement of receipt of reports will be documented in lieu of signature.
