What the inspector wrote

On February 16th, 2022, at approximately 9:00 AM, Licensing Program Analysts (LPAs) Arianna Manabat and Soleil Marx met with Director Carrie Robinson. The purpose of today's inspection was discussed with the Director. During the visit LPAs observed 41 children supervised by seven staff members. During today's visit, LPAs observed three staff members present in the facility all with "In Process" criminal background clearances. Based on record review, LPAs found that the three staff members are associated to the facility but have not been cleared through the Guardian system. Based on record review and interviews it was determined that all three staff members have worked at the facility for more than five days. During the visit, LPAs also observed one preschool child enter into the playground without staff supervision. LPAs observed the child playing in the playground for approximately twenty seconds before Staff 2 (S2) entered the playground and brought the child back inside of the facility. During interviews it was stated that the child's authorized representative left the child in an unoccupied room and that the child had then walked outside to the playground. It was also stated in interviews that the authorized representative did not communicate with the staff members about the child's location during drop-off. Record review indicates that, previously, on February 1st, 2023, one Type A citation was issued for the same regulation, lack of supervision. Based on the inspection, Title 22 Deficiencies have been issued on the attached on the LIC 809-D pages. The Licensee was informed that this report dated on 12/12/2022 documents two Type A citations which shall be posted for 30 consecutive days. An immediate civil penalty is being assessed in the amount of $1750. The Licensee shall also provide a copy of this licensing report to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. Continued on 809-C.... A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. A signed Acknowledgement of Receipt of the Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. The Licensee has been provided with appeal rights.

This requirement is not met as evidenced by LPA's record review, interviews, and observations of the presence of three working staff members who have not obtained criminal background clearances which poses an immediate health and safety risk to children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    The licensee shall provide care and supervision as necessary to meet the children's needs. No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by LPAs observing one child exit the preschool classroom and enter the playground for approximately thirty seconds which poses an immediate health and safety risk to children in care.
