What the inspector wrote

Continued from LIC9099... During interviews, it was stated by staff members that they cannot fully provide adequate supervision to children in care as they are responsible for changing multiple diapers alone in a classroom without an additional teacher. Staff stated that, during this time, they are focused on abiding by diaper changing procedures, ensuring the personal rights and safety of the children on the changing table. Staff stated that, during diaper changing time, they cannot visually supervise other children who are engaging in daily activities. Staff have also stated that, during the times when they are alone outside and within ratio, that they are unable to provide one on one support to the children who are biting, as they have to ensure that all children are staying safe when they are utilizing outdoor play equipment. During today's visit, LPA Manabat observed multiple children, in a preschool classroom, who were occupying the restroom stalls during nap time without visual supervision from a teacher. LPA observed that, where the teacher was positioned, the teacher was not able to visually supervise the children. During interviews, it was stated that, reversely, when teachers are changing a child in one of these stalls, that they are unable to see the rest of the children in the classroom. Based on observations and interviews with staff members, parents, and the allegation for lack of supervision was found to be SUBSTANTIATED which poses an immediate threat to children in care. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099-D. See the attached LIC9099-D for Title 22 Deficiencies. The Director was informed that this report dated 03/29/2023 documents one Type A citation which shall be posted for 30 consecutive days. The Director shall also provide a copy of this licensing report to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Director has been provided with appeal rights. Exit interview conducted with Director, report was reviewed, and appeal rights were provided. Director received a Notice of Site which must remain posted for 30 days. Continued from 9099............ Director stated that, if parents request, the facility will notify them immediately through a phone call. During the investigation, LPA observed staff members changing children's diapers and checking for needed changes. LPA observed that the staff members will utilize a white board with the diapering information to keep track of the children's diapers. LPA observed that the facility does has an app on their iPads that can be used to track diaper changes but that diaper changes are not always recorded on this app. Upon record review and observation, LPA Manabat has found that diaper changes are including the children's diaper cream if rashes are present on the child. Based on the information obtained, LPA was not able to determine that staff did not notify authorized representative of unusual incidents and that staff do not change day care child's diaper as needed resulting in skin irritation, therefore, the allegation is determined to be UNSUBSTANTIATED, meaning that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove it. An exit interview was conducted. Notice of site visit and appeal rights were also addressed. The Notice of site visit shall remain posted for 30 days for guardian/parental review.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    The licensee shall provide care and supervision as necessary to meet the children's needs. No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by staff unable to prevent children from being bitten as a result of an inablility to visually supervise children which poses an immediate health and safety risk to children in care.

  • TEACHER QUALIFICATIONS AND DUTIES

    101216.1 Teacher Qualifications and Duties: A teacher shall have completed, with passing grades, at least six postsecondary semester or equivalent quarter units ...or shall have obtained a Child Development Assistance Permit... This requirement was not met as evidenced by: LPA observed one aide supervising twelve children alone in a preschool room.
