What the inspector wrote

Licensing Program Analyst (LPA) Martinez conducted an unannounced complaint visit and met with Director Carrie Robinson. It was alleged the facility is operating out of ratio. On 2/2/22 LPA Martinez interviewed four witnesses regarding the allegation. Two of the witnesses denied the allegation stating two staff are assigned to the room at all times. Two additional witnesses stated they were on site during the week of 1/24-1/28/2022 and that there was a time when one staff was left with over 4 infants in the room. LPA Martinez received an initial copy of the staff schedule on 2/2/22 however it was not an accurate log of staff physically being in the classroom. On 3/17/22 LPA Martinez received a copy of the hand written log for the infant room from the current Director Carrie Robinson. On the document it shows that one staff was in the room (S1) from 6:15AM-7:15AM, (S2) was in the room from 7:00AM-9:52AM, (S3) from 8:50AM-11:36AM. Interviews with two witnesses described that the infant classroom had only one staff from 7:15AM-8:50AM with 7 infants. It should be noted that statements from four witnesses corroborated that the staffing issue was due to many staff being out for COVID-19 that week. Based on observations made by LPA Martinez on 3/17/22, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, are being cited on the attached LIC 9099D. Notice of Site Visit must be posted for 30 days from todays visit.

    There shall be a ratio of one teacher for every four infants in attendance. This requirement was not met as evidenced by; Based on interviews and record review it was determined one staff (S2) was alone with 7 infants from 7:15AM-8:50AM. This is an immediate health and safety risk to children in care.
