THIS REPORT IS AMENDED AND REFLECTED IN THE 9099 & 9099D DATED 1/14/25. THIS REPORT DID NOT ALLOW FOR A 9099D ATTACHEMENT TO CITE VIOLATIONS. On 1/14/25, Licensing Program Analyst (LPA), Michelle Perez, met with Lucia Vargas and conducted a visit to close a complaint investigation. Upon arrival there were 51 children, supervised by 04 staff in various classrooms during naptime. The complaint alleges,that staff are co-mingling children. LPA investigated the complaint allegations through interviews with staff, director, co-director and guardians. LPA also obtained relevant documentation that provided which staff and children were in specific classrooms. After reviewing all of the information, LPA found that the center had been co-mingling school aged and preschool, only during the first and last hour of each day, and was under the impression they had an approved waiver. LPA researched the facility file and found that although a waiver may have been requested approximately 6-years ago, there was no approved waiver on file. LPA advised the director to request a waiver for comingling. Based on LPAs observations and interviews, which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation was found to be substantiated.
