What the inspector wrote

On 06/19/2024, Licensing Program Analyst Katy Velazquez (LPA) conducted a field visit to the facility for the purpose of a case management inspection regarding a self reported Unusual Incident Report (UIR) dated 06/13/2024. LPA arrived at the facility and was met by Assistant Director Juanita Belen (D1). LPA disclosed the purpose of the inspection and was granted entrance. LPA toured the facility and observed 26 preschool aged children being supervised by 4 staff members. LPA determined, through accessing Guardian, that all required adults were background cleared and associated to the license. LPA conducted staff interviews. Interviews corroborate what was reported in the UIR: 3 staff members were in a classroom as children were waking up from nap time. 1 staff member opened the back classroom door to put a wet nap cot outside when a child ran out the door. The staff member who opened the door immediately ran after the child and retrieved the child. No children were ever without visual observation and the classroom maintained ratio. NO DEFICIENCIES were cited in the areas that were evaluated on 06/19/2024. An exit interview was conducted, and the report was reviewed with Assistant Director Belen. LPA provided D1 with Licensee Appeal Rights. A Notice of Site visit was posted by LPA and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

This requirement was not met as evidenced by an unusual incident occurring on 06/13/2024 which was not reported to the Department.

    Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights:...(1) To be accorded dignity in his/her personal relationships with staff and other persons.This requirement was not met as evidenced by S1 grabbing and shaking a day-care child on 06/12/2024. This poses/posed a risk to the health, safety, and personal rights of person(s) in care.
