101416.5 Staff-Infant Ratio (b)There shall be a ratio of one teacher for every four infants in attendance. (1) An aide may be substituted for a teacher when all of the following conditions are met: (A)There is a fully qualified teacher directly supervising no more than 12 infants; and(B)Each aide is responsible for the direct care and supervision of a group of no more than four infants. This requirement is not met as evidenced by: Director (D) did not comply with the section cited above as LPA observation, record reviews, and interviews revealed that staff present, were not qualified and did not have the appropriate documentation on file to meet Title 22 requirements, which poses an immediate health, safety, or personal rights risk to persons in care.

101429 Responsibility for Providing Care and Supervision for Infants (a) In addition to Section 101229, the following shall apply: (1) Each infant shall be constantly supervised and under direct visual observation and supervision by a staff person at all times. This requirement is not met as evidenced by: Director (D) did not comply with the section cited above as LPA interviews and witness statements revealed that infants received bruises and bite marks without staff knowledge, which poses an immediate health, safety, or personal rights risk to persons in care.
