TEACHER AIDE QUALIFICATIONS AND DUTIES

...(e) An aide shall work only under the direct supervision of a teacher....This requirement was not met as evidenced by an aide supervising a classroom alone without supervision of a fully qualified teacher. This poses/posed a health, safety or personal rights risk to persons in care.

Limitations on Capacity(a) A licensee shall not operate a childcare center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met as evidenced by school age children being enrolled into the facility under the preschool license and co-mingled into preschool classroom(s). This poses/posed an immediate Health, Safety, or Personal Rights risk to person(s) in care.

Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons…(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions...This requirement was not met as evidenced by T1 digging her nails into a day-care child on 08/09/2023. Thisposes/posed an immediate Health, Safety, or Personal Rights risk to person(s) in care.

Discipline(a) Any form of discipline or punishment that violates a child's personal rights as specified in Section 101223 shall not be permitted regardless of authorized representative consent or authorization. This requirement was not met as evidenced by T2 and staff members using inappropriate forms of discipline such as pinching, grabbing, pushing, and time-outs in the bathroom. This poses/posed an immediate Health, Safety, or Personal Rights risk to person(s) in care.

Reporting Requirements(d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department...This requirement was not met as evidenced by a child receiving an injury on 08/09/2023 which was not reported to the Department.

Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, ... Supervision shall include visual observation.This requirement was not met as evidenced by 2 children being left unsupervised on the playground on 12/01/2023.

i) Prior to employment or initial presence in the child care center, all employees and volunteers subject to a criminal record review shall:...(2) Request a transfer of a criminal record clearance as specified in Section 101170(f). Based on LPA observation and record review, D1 did not ensure that a staff member had been associated to the facilty's license before her employemnt at the facillity which poses an immediate health, safety and or personal rights risk to children in care.

Each center shall provide a variety of daily activities designed to meet the needs of children in care, including but not limited to:..(c) A teacher-child ratio of one teacher supervising 24 napping children is permitted provided that the remaining teachers necessary to meet the overall ratio specified in Section 101216.3(a) are immediately available at the center.Based on LPA observation, more than 24 children were napping in a classroom with 1 staff member supervising nap time.

ARTICLE 2. Administration of Child Day Care Licensing

On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training his requirement is not met as evidenced by: Based on record review of four staff files did not have current mandated reporter training certificates. This poses a potential health and safety risk to children in care.
