What the inspector wrote

On 6/11/2024, Licensing Program Analysts (LPAs) Loraine Perez and Amanda Sutter met with Facility Representative Mary Patten for the purpose of an unannounced, required - 1 year inspection. Facility hours of operation are from 7:00 a.m. - 6:00 p.m., Monday thru Friday. 65 preschool children of which 11 are in the Toddler Option classroom, were present at the time of arrival. 14 staff were present within the preschool classrooms. Five classrooms were part of the preschool inspection. During today’s visit 19 preschool children were present in the Armadillo classrooms with four staff. Upon review of staff records there was one fully qualified teacher with three aids supervising the group of 19 children, putting the classroom out of ratio. When entering the Safari classroom, LPA Sutter observed a child come through the connecting bathroom into the Safari room from the Sea Turtle classroom. The Director called out to staff in the Sea Turtle classroom, and the staff responded by coming through the bathroom to return the child to the classroom. LPA Sutter also observed that before the child came through there was another child in the bathroom unsupervised. All individuals subject to criminal background review have obtained criminal record clearance. Facility Representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Report continues on LIC809-C. Page 1 of 3 LPA toured all activity and classroom spaces, restrooms, food service, and outdoor play areas . Facility Representative stated that there are no poisons at the facility. Toxic and hazardous items are inaccessible to children. Furniture and equipment are in good condition, free of hazards. LPA observed the playground equipment and outdoor activity space is maintained and in good condition. There is adequate shade on the playground . Toileting facilities are in safe, sanitary, and operating condition. Facility provides breakfast, lunch, and PM snack. Menus were posted in the facility. The food preparation space is free of litter and all food was protected against contamination. Storage containers with solid waste have tight-fitting lids. Drinking water was readily available to children via water pitchers and disposable cups. LPA observed electronic signature of authorized representatives sign-in and sign-out record. There are no firearms or bodies of water on the premise s. LPA observed a functional carbon monoxide detector. 14 Staff files were reviewed and complete. At least one staff member present today has current Pediatric CPR and First Aid certification. AB 1207 Mandated Reporter training certificates are maintained in staff records. Six children's records were reviewed. It was observed that five out of six children’s records was missing LIC701 Physician’s Report. Medications were verified. Medications are properly stored and labeled, inaccessible to children. This facility provides Incidental Medical Services – IMS. LPA reviewed storage of “medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. For IMS information see PIN 22-02-CCP . Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. Report continues on LIC809-C. Page 2 of 3 For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 ( PIN 21-21.1- CCP ). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP . Facility Representative was informed of the www.mychildcareplan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California. Based on the inspection, three Title 22 Deficiency have been issued on the attached LIC 809-D. The director was informed that this report dated 06/11/2024 documents two Type A citations which shall be posted for 30 consecutive days and one Type B citation. The director shall also provide a copy of this licensing report to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. Because the citation involved a repeat violation for ratio, an immediate civil penalty of $250 has been issued. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with Director Mary Patten. A notice of site visit was given and must remain posted for 30 days.
