Inspector’s narrative

What the inspector wrote

LPA arrived to the facility to open a complaint. During the inspection, LPA observed deficiencies that were unrelated to the complaint allegations. At 8:50am, LPA observed 7 toddlers in the toddler room supervised by one staff (S1). This teacher did not have infant units. The ratio in a toddler classroom is 6:1 and the room was observed to be out of ratio at the time of the inspection. LPA was told an additional teacher was due to arrive at 9am so the director stepped into the classroom to bring the room into ratio until the additional teacher arrived. The Redwood classroom was observed to be out of ratio with 24 children an aid and a fully qualified teacher (FQT). The outside playground was out of ratio with and aid and a FQT supervising 29 children. LPA observed staff (S2) was present in the facility today and did not have a fingerprint clearance. The employee has been working in the facility for more than 5 days, therefore Civil Penalties are assessed in the amount of $500. Title 22 Deficiency has been cited on the attached LIC 809-D . LPA Amanda Blesi informed facility representative, Reonna Walker, that this report dated 01.05.22 document(s) two Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Amanda Blesi informed the facility representative to provide a copy of this licensing report dated 01.05.22 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Appeal Rights given. Exit interview conducted and report was reviewed with the Licensee Hamid Hosseini who arrived towards the end of the inspection when the director had to leave. A notice of site visit was given and must remain posted for 30 days.Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

  • CRIMINAL RECORD CLEARANCE

    CRIMINAL RECORD CLEARANCE: (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(1)Obtain a California clearance or a criminal record exemption as required by the Department. This requirement was not met as evidenced by: S2 was observed working in the facility today supervising children and used in ratio. LPA conduced a file review and Guardian search and it was determined a fingerprint clearance was not located for S2. (see LIC811 for name). S2 has been employed since 9/27/21. This is an immediate risk to the health and safety of children in care. Civil Penalties are assessed in the amount of $500.

    Teacher Child Ratio: The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. (1) A ratio of one fully qualified teacher (as specified in Section 101216.1(c)) and one aide for every 18 children in attendance in a preschool program is allowed when the aide meets the qualifications specified in Section 101216.2(d). This requirement was not met as evidenced by: the Redwood classroom had 24 children supervised by an aide (S2) and a FQT (S3). LPA observed an aide (S4) and a FQT (S1) supervising 29 children on the playground. Both the classroom and the playground were out of ratio. This poses a risk to the health and safety of children in care if not corrected.

    Infant teacher qualifications and duties: Prior to employment, an infant care teacher shall have completed, with passing grades, at least three postsecondary semesters or equivalent quarter units in early childhood education or child development, and three postsecondary semester or equivalent quarter units related to the care of infants, at an accredited or approved college or university. This requirement was not met as evidenced by: S1 was observed supervisign toddlers ages 18-36 months in the toddler room. S1 does not have infant units. This poses a potential health and safety risk to children in care.

    Toddler ratio:(3) A ratio of six children to each teacher is maintained for all children in attendance at thetoddler program. An aide who is participating in on-the-job training may be substituted for a teacher when directly supervised by a fully qualified teacher.This requirement was not met as evidenced by: LPA observed S1 in the toddler room supervising 7 toddlers. This poses an immediate risk to the health and safety of children in care.
