What the inspector wrote

Licensing Program Analyst Erwina Pascual-Golamco (LPA) conducted an unannounced annual inspection and met with Licensee, Michelle Jones. All individuals subject to criminal background review have obtained a criminal record clearance. Facility hours of operation are Monday through Friday 8:30 AM to 5:00 PM. LPA observed that the annual facility fees are current. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. A health and safety inspection were conducted in areas accessible to children. Off-limit areas include: all rooms and bathrooms on second and third floors, combination locked shed, pool area, and garage . Licensee acknowledged that children may never enter these off-limit areas. The fireplace and stairs are fenced or barricaded. Licensee acknowledges that when children less than five years old are in care, stairs shall be fenced or barricaded. LPA observed that the facility is in good repair with heating and ventilation for safety and comfort. The facility has equipment and age-appropriate materials for children. LPA observed the required documents were posted where visible to parents. LPA observed that there were no hazardous items\342\200\224such as cleaning compounds, medications, or sharp objects that are accessible to children. The 2A-10-BC fire extinguisher appeared to be in working condition and is accessible. LPA observed the smoke and carbon monoxide detectors are functioning. continued on LIC809-C... Licensee stated there are weapons/firearms in the home, and LPA observed that weapons and ammunition were stored and locked separately where they are inaccessible to children. There is an in-ground pool in the back yard, pool is completely surrounded by a see through fence with a minimum height of 60 inches but LPA did not observed the gate swing away from the pool, self-close and self-latch as Licensee stated she lost the key to the device and has been locked sice. LPA did not observe windows or doors that provide direct access into the pool area. LPA observed the following in the pool area: a working alarm but LPA did not observe documentation that it is compliant with ASTM International Standard F2208, A life ring with a minimum exterior diameter of 17 inches and labeled as approved by the United States Coast Guard, a rescue pole with a body hook and a minimum length of 12 feet but LPA observed the rescue pole is not fixed. LPA observed Licensee\342\200\231s log of daily inspection of the drowning prevention safety features and safety equipment before opening the facility. The backyard is fenced. LPA observed a current children's roster and fire drill log which was last conducted on 08/05/25. LPA reviewed sample of children\342\200\231s files and observed required documentation. LPA observed the CPR/First Aid certificate was valid until 01/27. Mandated Reporter Training (MRT) certificate was valid until 01/27. Licensee was reminded that both CPR/First Aid and MRT must be completed every two years. LPA reviewed facility files and observed the required documentation. Licensee is aware of and practicing safe sleep regulations. As an additional resource, LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep . LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP . When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the https://mychildcareplan.org/ a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform. LPA reminded licensee about the quarterly updates provided by the Childcare Advocates Program. Based on the inspection and record review, Type A Title 22 Deficiency has been issued on the attached LIC 809-D page. LPA Erwina Pascual-Golamco informed licensee Michelle Jones that this report dated 12/16/25 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed the licensee Michelle Jones to provide a copy of this licensing report dated 12/16/25 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS on 08/29/25. Licensee has been provided with appeal rights. Exit interview was conducted, report was reviewed with the licensee, Michelle Jones.

Licensee stated she lost keys to the device but has been locked since, which poses an immediate health, safety or personal rights risk to persons in care.

    Based on observation, and interview, the licensee did not comply with the section cited above as LPA observed pool alarm working, but Licensee can't find documentation that pool alarms meets ASTM International Standard F2208 at time of LPA visit, which poses/posed a potential health, safety or personal rights risk to persons in care.
