What the inspector wrote

Therefore, although the alleged violation may have happened or are valid, the preponderance of evidence standard has not been met to fully prove or disprove that they did or did not occur, therefore they are unsubstantiated . There is no deficiency issued today. An exit interview was conducted and notice of site visit and appeal rights were provided to Director Katherine (Katie) Ibarra. S1 also stated, “I didn’t know what to do and I removed the sticker from…hand.” In C1’s interview, LPA asked, “Can you show me with my hands what you mean by teacher pulled your hand up?” C1 grabbed both LPA’s hands, squeezed, and pulled them upward.” C2 also stated and showed LPA how S1 held on to C1’s wrist tightly. According to the parent interviews, they do not have any concerns about the staff handled day care child in a rough manner. Based on the video clip, interviews and inspections, the preponderance of evidence standard has been met; therefore, the above allegation is substantiated . The Title 22 deficiencies are being cited on LIC 9099-D. An exit interview was conducted wit h Director Katherine (Katie) Ibarra . A notice of site visit, a copy of this report, and appeal rights were provided to Director. Notice of site visit will be posted for 30 consecutive days.

    101223 Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights:(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.This requirement is not met as evidenced by: Based on observations of the video clip, interviews, and a record review, the facility did not comply with the section cited above by having an incident where Staff #1 handled a child in a rough manner when grabbing C1's hands to remove the sticker and toys, which poses an immediate health, safety or personal rights risk to persons in care.
