What the inspector wrote

2 Week Notice. (1) The Director may terminate your child's enrollment upon 2 week notice to you if the school's program cannot meet the developmental or special needs of your child. (2) It is not in the best interest of the school or other enrolled children to have your child continue in attendance. (3) If you fail to comply with any of the terms of this Agreement or any of the rules or policies of the center." Parent Handbook has an explanation of Suspended or Dismissed Students on pages 8 and 9. Facility/staff work with children and parents/guardians regarding behavior and developmental needs, and are informed and given notice following the facility's admission agreement. Staff and parent/guardian interviews revealed they have not witnessed nor observed staff speak inappropriately about day care child on occasion when children, staff, or parents/guardians can hear. LPA Interviews, observation, and facility documentation failed to corroborate the allegation that staff wrongfully terminated day care child and staff speaks inappropriately about day care child. Although the alleged violation may have happened or are valid, the preponderance of evidence standard has not been met to fully prove or disprove that it did or did not occur, therefore, it is UNSUBSTANTIATED. This report was reviewed with Director, and an exit interview was conducted. Appeal Rights were provided and a Notice of Site Visit (NOS) was provided to Director, who will post it for a period of 30 days for parental review

    101223 Personal Rights (a) The licensee shall ensure that each child is accorded the ff. personal rights: (3)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule...or other actions of a punitive nature...this requirement was not met, as evidenced by: Director did not comply with the section cited above as interviews and witness statements revealed that on at least one occasion, staff and parents/guardians observed a staff member yelling at children to have them comply with classroom rules, which poses an immediate Health, Safety, or Personal Rights risk to persons in care.
