Inspector’s narrative

What the inspector wrote

Licensing Program Analyst Jennifer Velasco (LPA) met with Licensee Margarita Kashirskaia (L1) to conduct an inspection for the purpose of approving a capacity increase from eight to 14 children, with an assistant. The Fire Marshal's Fire Safety Inspection Clearance has been received by the Department, and the home has been cleared for up to 14 children. LPA toured all areas of the home that are accessible to children. Today\342\200\231s census was eight children, of which two were school aged and six were preschool aged. No infants were in care at this time. L1 was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. Off-limit areas include: bedroom #3 (with bathroom) downstairs, and bedroom #4 (with bathroom) upstairs , as well as the gated stairs, the garage, and the fenced pool area. Licensee acknowledged that children may never enter these off-limit areas and she must notify the department if she wishes to make the rooms accessible to children. LPA observed a current children's roster and fire drill log. LPA observed a pull-down fire alarm and two new smoke detectors. L1 stated she does not have any firearms. LPA observed the badkyard pool is enclosed with a five foot fence and a self latching gate and thereby meets regulatory requirements. LPA reminded L1 that for any assistant she must ensure and maintain documentation of the assistant\342\200\231s current Livescan clearance and association to the facility, current Mandated Reporter training, immunization record, and other required records. L1 stated she understands the assistant\342\200\231s CPR/First Aid certificate must be current if the assistant is to be left alone with the children. LPA advised L1 that she must be present in the home a minimum of 80% of operating hours. LPA discussed with L1 the safe sleep regulations and the Child Care Licensing Safe Sleep web page at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed L1 of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services- IMS policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514- 0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm . LPA discussed current COVID guidelines with L1 and provided technical assistance. LPA discussed current COVID guidelines with L1 and provided technical assistance. LPA provided the Department\342\200\231s website WWW.CCLD.CA.GOV , so the L1 can obtain updated licensing information, new regulations and access forms. LPA advised L1 of their responsibility to stay current by reviewing PINs on the website. In the areas that were evaluated, no deficiencies were observed at the time of the inspection. Capacity increase is approved for a Large Family Child Care Home as of today. 11/17/2022. Facility is now licensed to serve a maximum capacity (when there is an assistant present) of 12 children with no more than four infants OR a capacity of 14 children no more than three Infants; one child must be in Transitional Kindergarten/Elementary School and one child must be at least six years old.
