What the inspector wrote

Licensing Program Analyst (LPA) Anna Morales conducted an Unannounced Pre-Licensing Inspection and was greeted by Diane and James Baird. LPA observed six children(one infant over twelve months and five preschool aged children). Licensees(Diane and James Baird) are the only adults residing at the home. LPA reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. Licensees have requested an increase of capacity from a Small Family Day Care (8 capacity) to a Large Family Day Care(14). Fire Clearance was approved on May 8, 2024. Days and hours of operation are Monday - Friday from 7:00 AM to 6:00 PM. Applicants have current Pediatric CPR/First Aid(expire on 12/2024) and Mandated Reporter Training( expires on 12/6/2024). Preventative Health and Safety Child Care Training with Lead and Nutrition was completed on 11/4/2022. Applicants own the home. Applicants does not have liability insurance. (continue on LIC809C) LPA toured the indoor and outdoor areas during today's visit. LPA observed a barricaded fireplace in the home. There are no stairs in the home. Off limit areas inside the home: master bedroom/bath, two bedrooms, one bathroom, hallway closet and attached garage. LPA observed a fully charged 3A40BC fire extinguisher, working combo smoke and carbon monoxide detector and fenced backyard. LPA observed a swimming pool with the(locked gate) proper fencing that meets Title 22 regulations. Off limit areas outdoor: left side of the yard with a swimming pool that is fenced off to children. Licensees state that there are no weapons in the home. Cleaning Products, toxic agents, medications, and sharp objects were inaccessible to children. LPA reminded Licensees that smoking, baby walkers, bouncers, jumpers, and similar items are not allowed in Family Child Care Homes. LPA discussed the safe sleep regulations with Diane and James Baird and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Diane and James Baird of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. SB 792 Immunization Requirements was also discussed. (continue on LIC809C) Licensees were informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California. LPA discussed Zero Tolerance related regulations with licensee and was advised of the assessment of $500 immediate civil penalty and an ongoing $100 per day per violation continues until the violation(s) is corrected. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform.
