What the inspector wrote

Licensing Program Analyst (LPA) Pedro Solorio-Gutierrez met with licensee Nancy Esparza for an unannounced annual inspection. LPA explained the reason for the visit. Present were licensee, her Mother, Jovita Ramirez, and four daycare children, three of which are infants. Days and hours of operation are Monday to Friday, 6:00am to 6:00pm. The adults that reside in the home are licensee, her husband Jesus Cornejo, her mother, Jovita Ramirez, and two adult sons, Jesus Cornejo and Fernando Cornejo. Licensee handed LPA an updated LIC279 form with new days and hours of operation. A review of staff records on 08/19/2025 indicates that all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Licensee Nancy Esparza was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption prior to initial presence in a Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if the regulation is violated. LPA toured the indoor and outdoor areas during today's visit. LPA did not observe a fireplace. LPA observed and stairs barricaded. Off-limit indoors: first floor bedroom, first floor master bedroom with bath, pantry in the kitchen, two hallway closets on the first floor, an attached garage, and entire second floor, which includes: three bedrooms, bathroom, and loft. LPA observed a fully charged 3A40BC fire extinguisher, working smoke detector, working carbon monoxide, fenced backyard, and no bodies of water. Off limits outdoors: right side of home that is fenced off to children. LPA observed one dog in the garage. Licensee states that there are no firearms/weapons in the home. LPA observed licensee have a current CPR and First Aid certification expiring 04/27/2027and completed Mandated Reporter training on 03/09/2025. LPA observed Jovita Ramirez have a current CPR and First Aid certification expiring 04/27/2027 and completed Mandated Reporter training on 05/03/2025. LPA observed a current roster of the children and a fire and disaster drill log which was last completed on 07/31/2025. LPA reviewed six children's files and observed all forms are completed, children have current immunization records and infants have sleep logs. Licensee does have daycare insurance and LPA verified current policy. LPA discussed SB792 Immunization Requirements and observed licensee has immunization records on file. No IMS is administered by the facility. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Supervision of children was discussed with licensee and she understands that she must be present in the home during day care hours and ensure that the children are supervised at all times. Licensee understands her capacity options and she understands that she cannot have more than eight children in the home at any time. Licensee understands if she transports children via vehicle, children cannot be left in parked vehicles unattended at any time. LPA discussed the safe sleep regulations with Licensee Nancy Esparza and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee Nancy Esparza of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Licensee Nancy Esparza was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the LICENSEE NANCY ESPARZA confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Exit interview conducted and report was reviewed with the licensee Nancy Esparza. No deficiencies cited during the visit. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
