Based on record review and Licensee admission, the licensee did not comply with the section cited above in that a disaster drill has not be completed and no log was available for review, which poses/posed a potential health, safety or personal rights risk to persons in care.

101161 Limitations on Capacity (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license…This requirement is not met as evidenced by: Based on observations, interviews conducted, and records reviewed, LPA observed five school-age children present outside with six preschoolers upon entry into the facility and all children were eating lunch outside together during the visit which poses an immediate safety risk to children in care.

Based on observation, interview conducted, and records reviewed, the licensee did not comply with the section cited above as licensee did not ensure LIC 995 forms were signed for two out of four children which poses a potential personal rights risk to children in care.

Based on observation, interview conducted, and records reviewed, the licensee did not comply with the section cited above as licensee did not ensure documentation of good physical health for all personnel was maintained, including clearance for tuberculosis, which poses a potential health risk to children in care.

Based on record review, the licensee did not comply with the section cited above in 2 out of 2 staff did not have a current mandated reporter certificate on file, which poses/posed a potential health, safety or personal rights risk to persons in care.
