Inspector’s narrative

What the inspector wrote

For discipline staff verbally redirect children. It was also disclosed; a staff member told another staff member they mistakenly picked up a child by their wrist, while preventing the child from falling off a child size sofa. A staff member is “snappy” and stern with children. A staff member needs to work on their communication skills. During children interviews, it was disclosed that children like attending the facility, staff are nice to children, staff are not mean to children. It was also disclosed, some staff yell at children and children don’t know what is used as a form of discipline. Inspections were conducted March 5, 2021, March 12, 2021, March 23, 2021 and today April 29 2021. During the inspections, LPAs made observations of staff and children interactions, reviewed records and video footage from March 3, 2020 between 12:00pm-12:30pm. During the review of the video footage, LPA Robinson observed A child who was repeatedly hiding behind child size furniture, climbing, jumping and flipping on a child size sofa and cabinet located in the 2 year old classroom. Two staff members verbally redirected the child, multiple times. After several attempts to redirect the child’s behaviors a staff member was observed holding the child by their left hand/wrist and guiding the child away from the sofa. The child slid their body down to the floor, while the staff member continued holding their left hand/wrist. The child stood up and climbed onto the sofa, the staff member then took their left hand/arm while continuing to hold the child by their left hand/wrist, placed their left hand/arm under the child’s right arm then carried the child to their napping cot. There were conflicting statements regarding staff speaking inappropriately to day care children and staff handling day care child(ren) roughly. Although the allegations may have happened or is valid, there is no preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are deemed unsubstantiated at this time. LPA Robinson provided the director with a copy of this report along with notice of site visit and appeal rights (LIC 9058) via email with an electronic “read receipt”. The electronic read receipt of the emailed report acknowledges receipt of this report, notice of site visit and appeal rights. A copy of this report was emailed to the director during this Tele-inspection on April 29, 2021.

    The Department has the authority to inspect, audit, and copy child or child care center records upon demand during normal business hours. Records may be removed if necessary for copying. Removal of records shall be subject to the requirements in Sections 101217(c) and 101221(d). The licensee shall ensure that provisions are made for the examination of all records relating to the operation of the child care center. This requirement was not met as evidenced by: on March 4, 2021, March 5, 2021, March 12, 2021, March 23, 2021 LPA Robinson requested a personnel record regarding Staff #1 performance evaluation for 2019-2021. On March 16, 2021 and March 19, 2021 LPM Williams also requested Staff #1 performance evaluation for 2019-2021.Facility staff stated they were unable to provide the record due to legal reasons. This is a potential risk to the health and safety of children in care.
