What Happened
During this tele-inspection to deliver complaint findings, the inspector requested personnel performance evaluations for Staff #1 from 2019 to 2021. The facility stated it could not provide the records for legal reasons, and the inspector advised that licensing regulations require personnel records to be maintained at the center and made available for review. A type B citation was issued.

The Department has the authority to inspect, audit, and copy child or child care center records upon demand during normal business hours. Records may be removed if necessary for copying. Removal of records shall be subject to the requirements in Sections 101217(c) and 101221(d). The licensee shall ensure that provisions are made for the examination of all records relating to the operation of the child care center. This requirement was not met as evidenced by: on March 4, 2021, March 5, 2021, March 12, 2021, March 23, 2021 LPA Robinson requested a personnel record regarding Staff #1 performance evaluation for 2019-2021. On March 16, 2021 and March 19, 2021 LPM Williams also requested Staff #1 performance evaluation for 2019-2021.Facility staff stated they were unable to provide the record due to legal reasons. This is a potential risk to the health and safety of children in care.
