Follow-up on corrections·April 29, 2021

Due to COVID-19, Licensing Program Analysts (LPAs) Sharleen Robinson and Laura Mejorado conducted a Tele-inspection with Director Toni Gavell, to deliver findings of a complaint. During the investigation LPA Robinson requested a personnel record ( Staff # 1 performance evaluations for 2019-2021) , the facility stated they were unable to provide the records due to legal reasons. LPA Robinson explained per Tittle 22 regulations the facility is required to provide Licensing with all personnel records related to the licensed childcare facility. The following tittle 22 regulations sections were discussed: 101217(c) All personnel records shall be available to the Department to inspect, audit, and copy upon demand during normal business hours. 101217(d) All personnel records shall be maintained at the childcare center and shall be available to the licensing agency for review. 101200(c)(1)The Department has the authority to inspect, audit, and copy child or child care center records upon demand during normal business hours. Records may be removed if necessary for copying. Removal of records shall be subject to the requirements in Sections 101217(c) and 101221(d). The licensee shall ensure that provisions are made for the examination of all records relating to the operation of the child care center. See LIC809D for type B citation. During the exit interview, LPA Robinson provided the director with a copy of this report along with appeal rights (LIC 9058) via email with an electronic “read receipt” . The electronic read receipt of the emailed report acknowledges receipt of this report and appeal rights. A copy of this report was emailed to Licensee during this Tele-inspection on April 29, 2021.
