What the inspector wrote

On 02/16/2023 at 2:35 PM Licensing Program Analyst (LPA) Susan Brewer arrived at the facility to conduct an annual inspection. LPA was greeted by Licensee granted entry to tour the facility, inside and out. LPA reviewed records, and observed and/or discussed the following: Due to time constraints, the inspection will be continued to complete the annual inspection at a later date. Normal days and hours of operation are Monday- Friday, 7:30 AM to 5:30 PM OFF-LIMIT AREAS INCLUDE: 1st Floor bedrooms, Laundry room, Entire 2nd Floor, Pool area, Garage. The inspection consisted of reviews of the following domain: Physical Plant, Care and Supervision, Records, Facility Administration, Staffing Ratio and Capacity, Personal Rights. The inspection found the facility to be in compliance in these domains, except as noted on the LIC809D. \302\267 The facility is NOT operating within the licensed capacity and appropriate ratios on 02/16/2023. At 2:35 PM LPA conducted a census of 8 children present and conducted a file reviews which revealed that 5 of the 8 children present were under the age of 24 months. \302\267 The Licensee is present in the home and has ensured that children in care are supervised. \302\267 When temporarily absent from the home, the Licensee shall arrange for a substitute adult to care for and supervise children \302\267 A working telephone is present. \302\267 Appropriate fire extinguisher, smoke detector and carbon monoxide detector are present and were tested by the Licensee during this inspection on 02/16/2023. \302\267 All hazardous items are inaccessible, this includes detergents, cleaning compounds, medications and other items which could pose a danger to children. \302\267 Storage of poisons is inaccessible to children and locked. \302\267 There is a properly barricaded fire place \302\267 No guns or weapons present as stated by the Licensee Brenda Tucker. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 regulations. \302\267 Stairs are barricaded on 02/16/2023. \302\267 Home is clean and orderly, with heating and ventilation for safety and comfort \302\267 Safe and appropriate toys and equipment are present for both indoor and outdoor activities. \302\267 Outdoor play areas are fenced and/ or appropriate supervision is present \302\267 Verification of control of property on file \302\267 Pediatric CPR and First Aid Card expired 07/2019. The licensee renewed the training online in May 2022, from a vendor that was not EMSA approved. \302\267 Health & Safety Certificate \302\267 Mandated reporter: General: NOT ON FILE; AB1207 Child Care Expires: NOT ON FILE \302\267 Fire clearance: 09/15/1994 \302\267 Documentation of fire & earthquake drills to be conducted every six months: Last drill in Dec. 2021 \302\267 There are bodies of water on 02/16/2023, the licensee has an underground pool on the property. Licensee understands all bodies of water including ponds, above ground pools & spas, in-ground pools & spas, and some fountains must be properly covered or fenced per Title 22 regulations. The Department must be notified before and after installation of the above types of bodies of water. In addition, all wading pools or similar product must be emptied immediately after use and stored in an upright position. \302\267 Clean, safe and age appropriate toys on 02/16/2023 \302\267 Children\342\200\231s files are NOT complete. By the licensee's own admission, one infant present and in care on today's date did not have a file and the other 4 infants present and in care did not have safe sleep logs and or LIC9227 Infant Safe Sleep plans where required. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA Susan Brewer, discussed the safe sleep regulations with licensee Brenda Tucker, and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.     Based on LPA interview and record review, the licensee Brenda Tucker, did not comply with the section cited above in the licensee stated that she and her staff did not complete the mandated reporter training and was unaware of the requirement to complete the Mandated Reporter Training Part 1 & 2, which poses a potential health, safety or personal rights risk to persons in care.
