What the inspector wrote

Licensing Program Analyst (LPAs), Eric Ramos and Perla Ordones conducted a required/annual inspection as part of a compliance review. This is a combination center, and the other licensed programs are: School-Age and Preschool which were also inspected on this date. A tour of the inside and outside of the facility was granted and the following was observed and/or noted: \302\267 The following items were posted and updated where necessary: - License - Emergency Disaster Plan (LIC610) and Earthquake Preparedness Checklist (LIC9148) - Parent\342\200\231s Rights Poster (PUB393) - Personal Rights (LIC613A) - Child Car Seat Law - Menu \302\267 The facility is operating with the limits as stated on the license. \302\267 Ratios are being met during this inspection. \302\267 Classrooms are adequately equipped with age and size appropriate furniture and equipment and are free of hazards. \302\267 There are no weapons present at the facility as stated by Director Kristen Garnatz. \302\267 There are no accessible bodies of water present. All wading pools or similar products must be emptied immediately after use and stored in an upright position. \302\267 Drinking water is provided in the indoor/outdoor activity space by water fountain and water pitchers are available with disposable cups. \302\267 Medications are stored where inaccessible to children. \302\267 Hazardous items are stored where inaccessible to children which include: Disinfectants, cleaning solutions and other items that are dangerous. \302\267 Poisons and toxins are locked and inaccessible to children. \302\267 All floors were observed to be clean and safe. \302\267 Highchairs and tables have broad based legs and trays lock into place. \302\267 Changing tables are within arm\342\200\231s reach of a sink; padding is at least 1\342\200\235 thick with raised sides of at least 3\342\200\235 covered in washable vinyl or plastic. However, during facility tour, LPAs observed wear and tear on the infant changing table in the classroom. \302\267 Hand washing is completed before and after each diaper change and before feeding an infant. \302\267 Bathrooms were observed to be safe, sanitary and in operating condition; there is at least 1 potty chair for every 5 potty-training infants. \302\267 Playgrounds are enclosed by appropriate fencing and free of hazards. \302\267 Outdoor activity areas are supplied with age and size appropriate equipment in good condition. \302\267 The areas around or under high climbing equipment, swings, slides, and similar equipment have cushioned material that absorbs falls. \302\267 Food preparation area is clean, free of litter and rubbish and free of rodents and other vermin. \302\267 Menus shall be posted at least one week in advance in a place visible by the child\342\200\231s authorized representative, dated and kept on file for 30 days, and made available upon request. \302\267 Food is stored appropriately and protected from contamination. \302\267 All storage containers for solid waste were observed to have tight-fitting covers that are kept on, and in good repair. \302\267 Sign in/Sign out record was reviewed and meets regulation requirements. \302\267 Disaster drills are conducted at least every six months \342\200\223 last drill conducted on 01/01/25. A review of staff and children's records were conducted as part of this evaluation. \302\267 The licensee/director is asked to update the following documents, if applicable, and submit to licensing within 30 days: 1. LIC 500 Personnel Report 2. LIC 610 Emergency & Disaster Plan 3. Parent Handbook/ Program Curriculum/Admission policies and procedures/ fee schedule. 4. LIC 309 Administrative Organization. 5. LIC 308 Designation of Administrative Responsibility. \302\267 Children\342\200\231s records were found to be complete during this inspection. \302\267 A staff member is present with current Pediatric CPR/First Aid which expires on 04/2025. \302\267 Opening and closing staff member\342\200\231s CPR/First Aid expires on 04/2025. \302\267 Director completed Health and Safety training. \302\267 All staff present do not meet minimum qualifications for the position for which they were hired. During record review, LPAs observed that S1, S2, S3, S5 and S6 did not have accredited and/or approved qualifications. \302\267 A review of staff records on 02/19/2025 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. LPA verified that the lead testing was completed in accordance with the Written Directives outlined in PIN 21-21.1-CCP. The following items were discussed with the Licensee/Director during inspection: This facility provides Incidental Medical Services \342\200\223 IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children\342\200\231s, personnel, and administrative records. For IMS information, see PIN 22-02-CCP . A Plan of Operation that includes IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm The Licensee was informed of their reporting requirements and is provided with the Regional Office\342\200\231s Unusual Incident Reporting email mailbox: UnusualIncidentReportsDO09@dss.ca.gov The Licensee can submit transfer forms to associate new individuals or to disassociate someone from your facility at: Associations_Disassociations862@dss.ca.gov LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep web page at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Licensee was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. See LIC809-D for cited deficiencies. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.     Based on interview and record review, the licensee did not comply with the section cited above as LPAs observed that of the 6 staff present in the two infant classrooms, only 1 staff was determined to be a qualified teacher, while the other staff have certificates on file whose accreditation could not be validated at this time which poses a potential health, safety or personal rights risk to persons in care.
