What the inspector wrote

Licensing Program Analysts (LPAs) Perla Ordones and Susan Brewer conducted a required/annual inspection as part of a compliance review. LPAs were granted entry by Director Juliana Tahan and a tour of the inside and outside of the facility was granted and the following was observed and/or noted: This is a combination center and the other licensed programs are: daycare and school-age which were not inspected on this date. A review of staff and children's records were conducted as part of this evaluation. The director is asked to update the following documents, if applicable, and submit to licensing within 30 days: 1. LIC 500 Personnel Report 2. LIC 610 Emergency & Disaster Plan 3. Parent Handbook/ Program Curriculum/Admission policies and procedures/ fee schedule (only if changes have been made) 4. LIC 309 Administrative Organization (only if changes have been made) 5. LIC 308 Designation of Administrative Responsibility (only if changes have been made) The following items have been posted and are updated where necessary: - License - Emergency Disaster Plan (LIC610) and Earthquake Preparedness Checklist (LIC9148) - Parent’s Rights Poster (PUB393) - Personal Rights (LIC613A) - Child Car Seat Law - Menu · The facility is operating with the limits as stated on the license. · Ratios are being met during this inspection. However, upon file review LPAs noticed that on one of the Child Supervision Records (CSRs) a staff member had noted that on 01/04/2023 the Toddlers Classroom was over capacity with 5 children left alone with one teacher. · Supervision is being met during this inspection. However, LPAs observed a stroller placed in the crib area to be blocking sight of a sleeping infant. LPAs brought this to the attention of staff and the stroller was promptly removed at 09:36AM. · Classrooms are adequately equipped with age and size appropriate furniture and equipment and free of hazards. LPAs did observe one crib to have a tight fitting sheet over the mattress with holes in it. No children were observed to have used the crib during the inspection and the matter was brought to the attention of the Director. · There are no weapons present at the facility as stated by Director. · There are no accessible bodies of water present. All wading pools or similar product must be emptied immediately after use and stored in an upright position. · Medications are not currently being handled by the facility. · Hazards are stored where inaccessible to children. This includes: Disinfectants, cleaning solutions and other items that are dangerous. · Poisons and toxins are locked. · All floors shall be clean and safe. LPAs advised Director on the importance of keeping area rugs/mats clean for children who crawl. Director stated she is attempting to bring in professional cleaners to deep clean the rugs sooner than the planned quarterly schedule. · Sanitation solution is out of the reach of infants. · Highchairs and tables have broad based legs and trays lock into place. · Changing tables are within arm’s reach of a sink; padding is at least 1” thick with raised sides of at least 3” covered in washable vinyl or plastic. · Hand washing is completed before and after each diaper change and before feeding an infant. · Bathrooms were observed to be safe, sanitary and in operating condition; there is at least 1 potty chair for every 5 potty-training infants though Director noted that there are no infants or toddlers currently enrolled who are potty training. Additionally, the potty chair located in the toddler’s restroom was observed to be dirty. Director stated that the potty chair would be cleaned as soon as possible though it is not being used currently by any of the infants or toddlers. · Playgrounds are enclosed by appropriate fences and free of hazards. · Outdoor activity areas are supplied with age and size appropriate equipment in good condition. · Food preparation area is clean, free of litter, rubbish and free of rodents and other vermin. · Food is stored appropriately and protected from contamination. LPAs advised Director on the importance of keeping expiration dates written on items removed from the original containers for health reasons. · All storage containers for solid waste, including moveable bins shall have tight-fitting covers that are kept on, and in good repair. · Menus shall be posted at least one week in advance in a place visible by the child’s authorized representative, dated and kept on file for 30 days, and made available upon request. · Uncontaminated drinking water shall be readily available both indoors and outdoors and provided by a filtered water pitcher. · The areas around or under high climbing equipment, swings, slides, and similar equipment shall be cushioned with material that absorbs a fall. The facility utilizes artificial grass turf to cushion high climbing equipment. · Sign in/Sign out record was reviewed and meets regulation requirements. · A Staff member is present with current Pediatric CPR/First Aid which expires on 04/06/2025. · Opening and closing staff member’s CPR/First Aid expires on 04/06/2025. · Director completed Health and Safety Training. · A review of children’s records was conducted, and records were found to be incomplete during this inspection. During record review, LPAs found that of the infants present the day of the inspection, four children did not have the Individual Infant Sleeping Plan (LIC9227) on file and they were under the age of twelve months. Additionally, three children were observed to be sleeping on their stomachs and did not have LIC9227’s on file indicating they were able to roll over of their own accord. LPAs also found that nine of the infants and toddlers present did not have a Needs and Services plan on file as required per regulations. · Disaster drills to be conducted every six months – last drill conducted on 02/28/2023. · The Director was informed of the reporting requirements and is provided with the Regional Office’s Unusual Incident Reporting email mailbox: UnusualIncidentReportsDO09@dss.ca.gov · A review of staff records on 04/19/2023 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. · The Director can submit transfer forms to associate new individuals or to disassociate someone from your facility at: Associations_Disassociations862@dss.ca.gov LPAs discussed AB 2370 and provided a copy of PIN 21-21.1-CCP which explains the requirement for lead testing of water. All licensed Child Care Centers operating in buildings constructed before January 1, 2010, shall test their water for lead. Director showed proof to LPAs that the facility was tested for lead. LPAs also informed Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP . A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPAs Ordones and Brewer informed Director Juliana Tahan that this report dated 04/20/2023 document(s) two Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Also, LPAs Ordones and Brewer informed the Director to provide a copy of this licensing report dated 04/20/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.     Based on observation and record review, the facility did not comply with the above regulation as LPAs observed three infants, without Individual Infant Sleeping Plans (LIC9227) on file, to be sleeping on their stomachs. Due to there being no LIC9227s on file, LPAs could not verify that children could roll of their own accord and that they were not placed on their stomachs by staff which poses an immediate health, safety or personal rights risk to persons in care.
