What the inspector wrote

Licensing Program Analyst (LPA) Rachel Zeron conducted a case management inspection with Director, Crystal Reynolds. A case management inspection is being conducted in response to the receipt of an unusual incident report (UIR) from the facility. The UIR was received by the licensing agency on 08/31/2023. The incident occurred on 08/29/2023, the UIR documented an incident where a staff member was accused of violating a child's personal rights. The incident was self reported and the facility conducted an internal investigation into the matter. During today's visit, LPA investigated the incident, staff were interviewed and the following was disclosed. A child,child 1 (C1) was using the bathroom, when a teacher, Staff 1 (S1) came in to relieve the teacher that going to lunch. Upon arrival, S1 attempted to assist C1 with C1's clothing. S1 indicated that S1 assumed that C1's clothing were soiled due to the garment being on the floor. C1 wanted to wear the garment that was on the floor and refused to wear an alternate clean garment. Staff indicated that S1 commented to C1, that if C1 did not wear the clean garment that C1 would have to sleep in C1's undergarments. C1 chose not to wear the clean garment and proceeded to fall asleep in C1's undergarments and a blanket. C1 was clothed at the time when C1 had awakened. It was also revealed that staff refused to put the garment in question back on the child and spoke to the child in an inappropriate tone. Due to conflicting information, LPA is unable to determine whether the incident did or did not occur. Staff 1 received a refresher training on personal rights, as well as reporting requirements. Based on the information obtained, there appeared to be no violations of Title 22 Regulations pertaining to the reported incident at this time. LPA conducted an exit interview with Director, Crystal Reynolds and provided a copy of this report. A Notice of Site Visit was issued and must remain posted for the next 30 days.
