What the inspector wrote

LPA made a subsequent unannounced visit to the facility on 04/29/2026 for the purpose of conducting further interviews. It was disclosed by pertinent individuals that Staff #1 has made inappropriate comments towards children in care, specifically regarding the physical characteristics of children. LPA recorded multiple corroborating accounts/witnesses that observed Staff #1 make inappropriate comments around children in care. It was disclosed that Staff #1’s comments caused ridicule, laughter and feelings of sadness. Based on LPA’s observations, interviews conducted, and records reviewed/obtained, the preponderance of evidence standard has been met, therefore the above listed allegation, Staff does not treat children with dignity and respect, are found to be SUBSTANTIATED. Please see attached LIC9099D pages for Type A deficiency cited during this inspection. An exit interview was conducted, A copy of this report, LIC811 (confidential names) and appeal rights were given to Director, Malina Alvarez during this inspection on 05/06/2026. LPA issued a Notice of Site Visit and verified it was posted in a prominent location at the facility. LPA informed Director, Malina Alvarez that this report dated 05/06/2026 documents one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risks to the health, safety, or personal rights of children in care. Additionally, LPA informed Director, Malina Alvarez to provide a copy of this licensing report dated 05/06/2026 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A copy of this report, LIC9224 and Appeal Rights (LIC9058) were provided during this inspection.

  • PERSONAL RIGHTS

    101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights (1) To be accorded dignity in his/her personal relationships with staff and other persons.This was not met as evidenced by: Based on observation and interview, Pertinent individuals corroborated Staff #1 made inappropriate comments regarding children’s physical characteristics, causing feelings of ridicule, laughter and sadness. This poses an immediate health/safety and personal rights risk to children in care.

  • REPORTING REQUIREMENTS

    Reporting Requirements (d) Upon the occurrence… a report shall be made to the Department by telephone… In addition, a written report containing the information… shall be submitted to the Department within seven days… (C) Any unusual incident….This was not met as evidenced by: Based on observation and interview, Director had knowledge that Staff #1 allowed children to use the detached restroom without providing proper visual supervision and did not report the incident to Licensing as required. This poses a potential health/safety or personal rights risk to children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time…This was not met as evidenced by: Based on observation and interview, Staff #1 allowed children to use the detached restroom without providing proper visual supervision. This poses a potential health/safety or personal rights risk to children in care.
